Pay cited most often as reason for ORPD turnover, low morale, MTAS report says

It probably wasn’t the explanation that many expected, but pay was cited most often as the reason for turnover and low morale in the Oak Ridge Police Department, according to a report released Thursday.

Some have pinned most of the blame for the department’s woes—or perceived woes, depending upon your perspective—on Oak Ridge Police Chief Jim Akagi, and they had called for an investigation of the chief earlier this year on several different fronts.

Among those pressing for an investigation was Oak Ridge City Council member Trina Baughn. She and others had raised questions about the chief’s temperament, including whether he has outbursts and is vindictive, and what Baughn suggested is a high turnover rate.

But the City Council instead approved a review of the ORPD that focused on morale, turnover, and administrative policies. In March, Council hired the Municipal Technical Advisory Service at the University of Tennessee to conduct the six-month review, which was first proposed by Council member Kelly Callison. MTAS presented its findings in a 20-page report presented to the Oak Ridge City Council in a special work session on Thursday.

The report identified a primary culprit familiar to many workers: pay. But as officers have pointed out, they, unlike most other workers, face danger on a daily basis.

Most of those interviewed by MTAS thought that ORPD salaries are not suitable for retaining good employees, MTAS consultant Rex Barton told Council members Thursday. Whatever raises have been given in the past few years have been outstripped by the rise in the cost of benefits, Barton said.

Given that there is some confusion over recent events, I offer the following summary about where we are, how we got here, and where we are headed with regards to the Oak Ridge Police Department investigation.

The ORPD has seen a total turnover rate of 45 percent in the last four years, having lost 34 of our 76 employees. Five of those individuals have departed in the last four months. Since February, all Council members have received communications from at least seven former officers, three current officers, and countless citizens expressing concerns about leadership and a potentially hostile work environment. Others have communicated anonymously citing similar concerns and attributing their anonymity to fears of retaliation.

On February 9, during a five-hour televised meeting, and in front of the largest audience any of us had ever seen, City Council formally committed to investigate the root causes behind the turnover, morale, and policy issues in the Police Department.

The resolution that was ultimately approved was brought forward by Council member Kelly Callison who stated that “We think that’s a broad, a very broad term that allows an investigator, an independent investigator to look at the issues that might be present…”  At the end of the meeting, councilmember Chuck Hope stated, “The investigation that we’ve come to an agreement among the seven of us was reached unanimously…there’s enough information that it warrants an investigation…”

During this same meeting, Council committed to ensure that the investigation would allow for the anonymity of all participants and would include both current and past employees. Mr. Callison also suggested that council select Municipal Technical Advisory Service, specifically Rex Barton, to perform the work. Council did not select MTAS at the time, but agreed to hold a special meeting to select an entity to conduct the investigation and define its parameters. A review of the Oak Ridge Police Department by a University of Tennessee agency could cost $26,200.

The Oak Ridge City Council has asked the Municipal Technical Advisory Service at UT to review the ORPD, with a particular focus on turnover, morale, and administrative policies.

The initial 30-day review approved during a March 27 special meeting was going to be free. But an uproar ensued after the initial list of employees to be interviewed was sent to the police chief, city manager, and all Police Department employees, raising concerns about the confidentiality and impartiality of the review.

The City Council then expanded the scope of the inquiry. During an April 21 special meeting, members asked MTAS to interview all ORPD employees and try to interview former workers who have left in the roughly four years since Oak Ridge Police Chief Jim Akagi started. [Read more…]

The University of Tennessee agency asked to review the Oak Ridge Police Department has questions about the expanded scope of the inquiry—it could now include all current employees and some former employees—and the Municipal Technical Advisory Service at UT could charge the city $50 per hour for its work on the project.

MTAS had initially proposed a free limited review of turnover, morale, and administrative policies in the Oak Ridge Police Department. That review, which would have interviewed a random sample or cross-section of ORPD employees, was approved by the Oak Ridge City Council during a March 27 special meeting.

But the City Council asked to start over after the initial list of employees to be interviewed was sent to the police chief, city manager, and all Police Department employees, raising concerns about the confidentiality and impartiality of the review.

During an April 21 special meeting, City Council agreed 5-2 to start over by asking MTAS to interview all employees and try to interview former employees who have left since Oak Ridge Police Chief Jim Akagi started on July 1, 2011. But that meant the city’s contract with MTAS, which had already started the initial review, had to be renegotiated. [Read more…]

The review of the Oak Ridge Police Department has been expanded to include interviews with all employees. The review could also include interviews with former employees who have left the Police Department since Police Chief Jim Akagi started almost four years ago.

Initial plans had called for a limited review of the Oak Ridge Police Department and interviews of a random sample or cross-section of employees.

But the Oak Ridge City Council expanded the review during a special meeting on Tuesday. That special meeting was called after concerns were raised about the initial list of randomly selected interviewees being sent to the police chief, city manager, and all Police Department employees, which raised questions about the impartiality and confidentiality of the review.

By one estimate, the expanded review could include interviews with more than 100 people. And it’s not clear if the Municipal Technical Advisory Service at the University of Tennessee will agree to the expanded review, or if they might charge the city.

The City Council agreed to expand the review during a three-hour special meeting on Tuesday that included criticism of MTAS, accusations of collusion between Council members, and an attempt by Council member Trina Baughn to have resident Joe Lee, one of her chief critics, stop taking pictures during a public comment session. The review of the Oak Ridge Police Department will be extensive, but it’s not clear yet who will be interviewed, an official said Friday.

The proposal submitted by the Municipal Technical Advisory Service and approved by the Oak Ridge City Council in March called for interviewing a randomly selected group of police department employees. It also called for interviewing other city employees and officers and possibly talking to community leaders not directly employed by the city.

But some have expressed concern that others who want to speak, including former officers and city residents, might not be able to under the limited 30-day review and random selection proposed by MTAS.

“These men deserve to be heard, all of them,” said Christen Thomas, wife of Oak Ridge Police Department Officer John Thomas.

The independent MTAS review will use Police Management Consultant Rex Barton, a former administrative captain for the Athens, Tennessee, Police Department. MTAS is part of the Institute for Public Service at the University of Tennessee. [Read more…]

The Oak Ridge City Council on Monday night will consider a proposal to use the Municipal Technical Advisory Service to review turnover, morale, and administrative policies in the Oak Ridge Police Department.

The Council will also consider a contract to install a stoplight on Oak Ridge Turnpike in front of the Oak Ridge High School.

Also on tonight’s agenda is a resolution to appoint members of a joint city-school committee that will study options for repairing, replacing, or moving the Oak Ridge Preschool.

And Council members will consider a zoning ordinance amendment that could help the Main Street Oak Ridge project, which will redevelop the former Oak Ridge Mall. [Read more…]

Editor’s note: This is a copy of a March 3 letter to Oak Ridge City Council.

Dear Oak Ridge City Council members:

I am honored to communicate with you today regarding a very important issue affecting the members of the City of Oak Ridge Police Department. Many of them are affiliated with the Knox County Chapter of the Southern States Police Benevolent Association.

Before I discuss the issue at hand, I want to give you a very brief background regarding the PBA. We are not a union. We do not engage in union activities such as work disruptions or strikes. We are respectful when working with the administrations our officers serve. I’ve found most problems can be resolved if both parties come to the table with an open mind and a willingness to compromise.

The law enforcement officers from Anderson, Loudon, Roane, and Knox counties that make up our chapter depend on our local chapter board to monitor situations and protect their interests. Mostly those interests are confined to the following: a fair working environment and returning home safely at the end of a watch. [Read more…]

Many of those in this standing-room-only crowd that spilled out into a lobby Monday night turned out for an Oak Ridge City Council debate on whether to open an investigation into Police Chief Jim Akagi or, alternatively, reprimand City Council member Trina Baughn for the way she’s publicly handled concerns about the Police Department and its chief. In the end, Council approved a third-party review of ORPD turnover but rejected requests for two other probes.

After hearing from two dozen residents and a few former officers, the Oak Ridge City Council on Monday agreed to conduct an independent third-party review of turnover and morale in the Police Department. But members rejected a proposal to investigate the relationship between the police chief and city manager, and they declined to look into possible violations related to an order of protection issued against the police chief in Blount County in 2012 and dismissed in 2013.

The outcome appeared to generally please all sides, even if the process used to get there didn’t. It seemed to be a largely peaceful resolution to two weeks of divisive community debate and intense public scrutiny.

“I think we’ve taken a step in the right direction for addressing the concerns within the Oak Ridge Police Department,” said City Council member Trina Baughn, who first raised the issue publicly in a January 25 email about the turnover rate and other ORPD issues.

“I think it was a fair outcome, and one that came about as a result of the process working the way it was actually supposed to,” said Tasha Blakney, attorney for Oak Ridge Police Chief Jim Akagi, the subject of most of the allegations raised during the past two weeks.

The resolution to conduct an independent third-party review of the ORPD turnover was proposed by City Council member Kelly Callison during a five-hour meeting Monday night. It passed 7-0 after being amended to include a study of morale issues and administrative policies. [Read more…]

Police chief denies wrongdoing, no reason for investigation, attorney says

Oak Ridge Police Chief Jim Akagi denies any wrongdoing related to the concerns publicly raised in the past two weeks about the Police Department and his leadership, attorney Tasha Blakney said.

“The chief denies that he has been engaged in any wrongdoing at all,” said Blakney, who represents the chief. “Based on my review, I don’t see any reason for an investigation.”

But Akagi will respect the decision of the City Council, assuming the proper process is followed, and he will cooperate with the Council’s decision, Blakney said.

“The chief will respond to whatever City Council requires of him,” she said.

The investigation has been requested by Oak Ridge City Council member Trina Baughn. It’s on the agenda for tonight’s meeting, which starts at 7 p.m. in the Oak Ridge Municipal Building Courtroom. [Read more…]

15 percent turnover not necessarily cause for alarm, UT professor says

One of the initial concerns raised about the Oak Ridge Police Department last month was whether the turnover rate was high.

Oak Ridge City Council member Trina Baughn said she had calculated a 15 percent annual turnover rate in the 3.5 years that Police Chief Jim Akagi has led the department. That compares to a reported turnover rate of only 2.9 percent for the Knoxville Police Department, Baughn said.

“I’m sure you agree that having a turnover rate five times that of our neighbor demands further scrutiny,” Baughn told City Manager Mark Watson in a January 25 email.

But Oak Ridge municipal officials said they don’t think the turnover rate is significantly out of line with what it has been previously. Watson said an average of 7.25 employees per year have left in the last four years due to resignations, retirements, or being asked to leave.

Last week, a University of Tennessee professor suggested that a 15 percent turnover rate, by itself, might not be a cause for concern. [Read more…]

Former officers ask for investigation, hearing of officers’ concerns

Four former Oak Ridge police officers have asked the City Council to investigate some of the concerns recently raised about the Police Department and its chief, or to hear the concerns of officers.

The officers were responding to recent news reports about the police department and concerns raised about its turnover rate, as well as alleged policy violations included in a mid-January grievance filed by former Oak Ridge Police Department Officer Christopher Bayless. A few also cited letters written to the media by former Police Chief David Beams and former Lieutenant Jack Mansfield.

The officers expressed a range of concerns that include the alleged policy violations by Police Chief Jim Akagi and a Blount County order of protection in effect from April 2012 to June 2013, questions about the turnover rate and the chief’s leadership, and decisions about promotions, spending, and weapons.
