A probationary Oak Ridge police officer who once played football for Vanderbilt University and the Kansas City Chiefs has been investigated, terminated, and will be prosecuted for allegations of statutory rape of a 16-year-old girl and other charges, authorities said Monday.

The victim’s stepfather, who was in custody at the Anderson County Detention Facility in Clinton, made an allegation that the officer, Cassen Jackson-Garrison, 30, had engaged in inappropriate contact with his stepdaughter, Anderson County District Attorney General Dave Clark said in a press release. The allegation was made to an Anderson County Sheriff’s Department deputy investigator at the jail.

Clark said Garrison was one of two officers who met the victim when he responded to the victim’s home in connection with a domestic violence complaint. The victim’s stepfather was arrested because of that complaint and remains jailed at the ACDF, Clark said. [Read more…]

One person died after a multi-vehicle crash in the parking lot of Midtown Community Center sent at least a half-dozen people to the hospital after fireworks in Oak Ridge on Saturday night, authorities said.

The man who died has a Knoxville address, but police aren’t identifying him yet because family members are still being notified. It appeared that the man was on foot at the time of the crash, authorities said. The man who died was with his wife and children, Oak Ridge Police Chief Jim Akagi said.

Akagi said at least six people, including two children, were sent to three hospitals in three ambulances. The injured were taken to Methodist Medical Center in Oak Ridge and Children’s Hospital and University of Tennessee Medical Center in Knoxville. Their names and conditions weren’t immediately available.

Akagi said a pickup involved in the crash hit several vehicles, although it’s not clear how the man who died was injured.

It’s also not clear how fast the red Dodge pickup truck was going or whether it was backing up, he said. Witnesses said the truck had been parked at the east end of the parking lot facing east, or away from the entrance, and the driver backed up to leave as soon as fireworks were over. Witnesses said the truck was in reverse and driving fast. So far, authorities have been unable to confirm that.

“We don’t know what happened,” Akagi said.

But the truck’s back end appeared to have struck at least one vehicle.

Akagi said there were at least a half-dozen vehicles involved in the crash. He said he didn’t know if any other vehicles were moving at the time of the collision. [Read more…]

The Tennessee Bureau of Investigation is not investigating, two district attorneys said there was no violation, and the state agency that certifies police officers has completed its activities, officials said Wednesday.

That would appear to end the inquiry of Oak Ridge Police Chief Jim Akagi by the Tennessee Peace Officer Standards and Training Commission, or POST. In April, POST asked three authorities, including one federal official and two state officials, whether Akagi had violated state and federal laws by possessing a firearm after being issued an ex parte order of protection during divorce proceedings in Blount County three years ago.

The response from all three officials has been “no,” according to letters sent to POST.

Oak Ridge Today reported on the response from the U.S. Attorney’s Office, as reported by Akagi’s attorney Tasha Blakney, on Tuesday. The two state officials—Dave Clark, district attorney general in the Seventh Judicial District in Clinton, and Mike Flynn, district attorney general in the Fifth Judicial District in Maryville—sent their response to POST on Wednesday.

“The Tennessee Bureau of Investigation and our offices have concluded that based on what you submitted, there never has been an order of protection issued against Chief Akagi and thus no violation of an order of protection could have occurred,” Clark and Flynn said in a letter to Ray Farris, assistant director of the POST Commission. “Any criminal investigation in this case is closed.” [Read more…]

Officials say it was suicide. But the parents are skeptical.

So questions linger almost four years after Alexander John Heitman, 29, of Knoxville, was found dead in Cocke County after being reported missing by Oak Ridge Schools. Heitman reportedly died on Tranquility Ridge Drive outside Newport on July 25, 2011. Officials said it was suicide, a self-inflicted gunshot wound to the head.

But Heitman’s parents, Don and Annette Heitman of Adams, Wisconsin, find it hard to believe. They aren’t the only ones. Some current and former Oak Ridge residents, including City Council member Trina Baughn, are also skeptical of the official cause of death.

Heitman’s widow, Kristie Heitman, is not. In February, she released a suicide note that she believes Alex, who was the supervisor of business and support services for Oak Ridge Schools, wrote the day before he died.

Neither is Cocke County Sheriff Armando Fontes. In March, he said the case is closed, and there is no reason to continue pursuing it. Investigators found no evidence that anyone else was involved, Fontes said.

But Don and Annette continue to seek answers. They started a website in October 2013 and used it to raise questions about the case. They’ve also asked for the death investigation to be re-opened, hired attorney Hugh Ward to help them, and won the support of Baughn and others. They’ve also asked the FBI to investigate. ACSD: Daughter’s boyfriend charged with murder in Andersonville shooting

An Andersonville man has been charged with murder in a shooting that allegedly killed his girlfriend’s mother early Wednesday, authorities said.

William James McMillan, 48, is accused of fatally shooting Karen Zahrobsky, 66, according to authorities. They said McMillan, Zahrobsky, and Zahrobsky’s daughter, Christin Dixon, 45, all lived at 460 Lone Mountain Road in Andersonville, where the shooting allegedly occurred.

The shooting was reported at about 4:45 a.m. Wednesday. Zahrobsky was dead when deputies arrived.

McMillan was charged by the Tennessee Bureau of Investigation, which helped investigate. McMillan was booked into the Anderson County Detention Facility in Clinton, and he is being held on $625,000.00 bond. [Read more…]

DA: Crime down 12 percent in Anderson County

Crime dropped 12 percent in Anderson County and its cities in 2014, Anderson County District Attorney General Dave Clark said Wednesday.

It’s the eighth year in a row that crime has dropped, according to statistics released by the Tennessee Bureau of Investigation, Clark said in a press release. He said crime is down 42 percent in the county and its cities during the past eight years.

During that same period, crime was down in Tennessee by an “impressive” 16 percent, Clark said.

“However, locally, we have more than doubled the crime reduction that has been accomplished across the state,” he said. [Read more…]

Chief’s attorney calls it one more effort to vilify Akagi

The organization that certifies police officers in Tennessee has asked state and federal authorities to investigate whether Oak Ridge Police Chief James T. Akagi violated state and federal laws by possessing a firearm after being issued an ex parte order of protection during divorce proceedings in Blount County three years ago.

The April 27 letter from Ray Farris, assistant director of the Tennessee Peace Officer Standards and Training (POST) Commission, was sent to Mike Flynn, district attorney general in the Fifth Judicial District in Maryville; Dave Clark, district attorney general in the Seventh Judicial District in Clinton; and the U.S. Attorney’s Office for the Eastern District of Tennessee in Knoxville.

“Documents provided to our office indicate that an order of protection was issued by the Blount County Court against Chief Akagi on April 19, 2012,” Farris said in the letter. “During the effective period of this order of protection, Chief Akagi submitted his firearms qualifications scores to the Commission, which appears to be a violation of the aforementioned order of protection.”

But Tasha Blakney, an attorney for the police chief, has said Akagi was not prohibited from carrying a firearm.

“I am absolutely confident that there has been no violation of state or federal law in this family law matter with regard to the ex parte order of protection that was temporarily entered and subsequently dismissed,” Blakney said Thursday. “They simply don’t carry any implications for an individual’s Second Amendment rights. That’s just a function of understanding the way that Tennessee law works.” [Read more…]

League of Women Voters celebrates 69th birthday

Anderson County District Attorney General Dave Clark and Public Defender Tom Marshall will discuss the current status of the county’s justice system during Lunch with the League on Tuesday, April 21.

After their presentation, the League of Women Voters of Oak Ridge will celebrate its 69th birthday. Everyone is invited to stay after the meeting or come at 1 p.m. to celebrate with cake and social time, a press release said.

The presentation by Clark and Marshall is scheduled from noon to 1 p.m. Tuesday in the Social Hall of the Oak Ridge Unitarian Universalist Church at 809 Oak Ridge Turnpike. [Read more…]

The law in Tennessee has recently changed in a way that insults the memory of murder victims. Not a single photo of a victim prior to their murder is allowed to be shown during their killer’s trial. This problem needs to be solved, and voters can help.

Sadly, the gruesome photos of a corpse are the only presence homicide victims are granted during a trial. The defendant is allowed to be present and to be “cleaned up” and “dressed up” for the jury; but no picture of the victim can be presented.

For decades, it was a common practice for prosecutors to introduce into evidence a reasonable likeness of the victim prior to their murder in addition to crime scene photos. However, due to recent high-court rulings, trial judges now do not allow the practice for fear of having a verdict overturned. [Read more…]

A former corrections corporal with the Anderson County Sheriff’s Department has been indicted by the Anderson County Grand Jury on an assault charge after allegedly hitting an inmate, authorities said Wednesday.

Joshua Bryant, a prisoner at the jail, alleged that he was struck by the former corporal, Dustin McCoig, on October 22, 2014, while he was an inmate and while McCoig was at work and on duty at the Anderson County Detention Facility in Clinton, District Attorney General Dave Clark said in a press release.

Bryant and his family reported the incident, and an internal affairs investigation was launched, Clark said. The Sheriff’s Department presented the case to Clark, who in turn presented it to the Grand Jury on March 3. [Read more…]

Former nurse indicted on false report charge in prisoner death

A former nurse at the Anderson County Detention Facility has been charged with filing a false report in the death of a prisoner in July 2014, authorities said.

An autopsy revealed that the prisoner, Christopher C. Sullivan, died accidentally from a combination of alcohol and morphine, Anderson County District Attorney General Dave Clark said in a press release.

An indictment against the former nurse, Billy Joe Brockman, 49, of Clinton, “indicates that he unlawfully reported to Anderson County Sheriff’s Department investigators that he had measured and recorded the vital signs of Christopher C. Sullivan while knowing that he had, in fact, not measured or recorded the information,” Clark said. [Read more…]

The cause of his death has been questioned for months, but information released Friday said a former Oak Ridge Schools employee found dead in Cocke County in July 2011 wrote a suicide note the day before he died.

Alex Heitman, 29, was the supervisor of business and support services for Oak Ridge Schools. Cocke County authorities said he died from a self-inflicted gunshot wound to the head on July 25, 2011. The death was ruled a suicide.

But Heitman’s parents, Don and Annette Heitman, have been questioning since at least October 2013 whether their son’s death, which they call mysterious, was actually a suicide. They’ve been supported by a few residents and former residents and Oak Ridge City Council member Trina Baughn.

On Monday, a television station in Madison, Wisconsin, broadcast a story on Heitman’s death and his parent’s quest to find answers. In that story, Don Heitman said “we just don’t have the answers to prove that it was (suicide).” In that same story, Baughn said the information collected so far “points to something much bigger than a suicide.”

But Heitman’s widow, Kristie Heitman, told the TV station that she believes her late husband committed suicide, and she found what appears to be a suicide note on his computer after he died. [Read more…]
