Residents file ouster petition against Anderson County law director

Twenty-two Anderson County residents have filed a petition in Chancery Court seeking to remove Law Director Jay Yeager from office, alleging misconduct that includes perjury, forgery, and having pornography on a county computer.

The ouster petition was filed Friday afternoon in Anderson County Chancery Court in Clinton. It alleges Yeager, who became law director in September 2006, committed perjury on his sworn application to become law director eight years ago, forged the signature of retired Anderson County Sheriff’s Department Capt. Avery Johnson two years ago, and had a pornographic image on a county computer that was found about three years ago.

The petition asks the court to immediately suspend Yeager from his official duties pending a decision by the court, and it requests a trial. If Yeager is guilty of one or more of the charges, the petition said, he should be ousted from office.

“I’m devastated,” Yeager said Friday evening. “It’s just another assassination on my character and on my good reputation and all I’ve done for Anderson County.”

He said he thinks the ouster suit is politically motivated, and he called it “baseless and unwarranted.” [Read more…]

CLINTON—They’ve traded accusations of false claims and “mudslinging” and challenged each other on their courtroom experience. The debate has spilled over into mailed flyers, newspaper ads, and candidate forums.

On one side is Clinton attorney Michael Farley, a former Clinton City Council member and current city judge who is running for Anderson County chancellor in the Republican primary on Tuesday. On the other is Nicki Cantrell, who is also a Republican and Clinton attorney.

In particular, Farley has raised questions about the number of jury trials that Cantrell has handled and the number of contested hearings she’s had in Anderson County Chancery Court. He’s suggested she’s not telling the truth about her experience.

“If you check with the clerks, it’s not backed up,” Farley said. “She doesn’t have the experience I have.”

Clinton Attorney Phil Harber is campaigning for the Republican nomination for chancellor of the Anderson County Chancery Court. Harber, 59, a Clinton native, has practiced law more than 28 years in most of the trial and appellate courts in East Tennessee, including the United States federal courts, a press release said.

A Republican, Harber described himself in the press release as the only true conservative and the only true Republican seeking the Republican nomination for chancellor.

State high court declines to hear appeal in Rogers, Clinton suit

Last week, the Tennessee Supreme Court declined to hear an appeal of the dismissal of a lawsuit filed against the city of Clinton and a road-paving company, effectively ending a nearly 20-year-old legal battle.

A grassroots organization called Citizens for Safety and Clean Air made up of Norris residents formed to fight plans by the Rogers Group to reopen a rock quarry and build an asphalt plant on land in the Bethel community annexed several years ago by the city of Clinton. The group filed a lawsuit in Anderson County Chancery Court to stop those plans from going forward, alleging that the city’s rezoning of the property for heavy industrial use constituted illegal spot zoning and that the project would cause increases in heavy truck traffic and air and noise pollution.

Chancellor William Lantrip dismissed the suit, saying that zoning is essentially a legislative matter and not the domain of the courts. An appeals court agreed last fall, and last week, the state’s high court declined to hear the case, essentially clearing the way for the project to move forward.

Appeals Court rules against rock quarry foes

The Tennessee Court of Appeals late last week ruled against a group of citizens who had sued the city of Clinton and the Rogers Group over the city’s rezoning of land near the Bethel community to allow for the road-paving company to reopen its controversial rock quarry.

Citizens for Safety and Clean Air had filed the suit, alleging that the city’s rezoning of the land to M-2—or heavy industrial use—had been capricious and arbitrary and that it had constituted illegal spot zoning.

Anderson County Chancellor William Lantrip ruled against the plaintiffs earlier this year, and the case was appealed. [Read more…]

Norris annexation issues to be heard this summer

A hearing was held Monday in Anderson County Chancery Court regarding the annexations by the city of Norris of several properties along Highway 61. Some property owners objected, claiming that the proper policies and procedures had not been followed, but Chancellor William Lantrip ruled that all but one of the pieces of property had been properly annexed by the city.

He initially ruled that one parcel was not adjacent to the city’s Urban Growth Boundary at the time it was annexed, which is one of the requirements for cities to take in new land under state law. [Read more…]

With no objections from members, a city board on Thursday reaffirmed a decision from more than two years ago to declare four Applewood Apartment buildings unfit for human occupation and use, and declare them nuisances.

Joe Lee, a member of the Oak Ridge Board of Building and Housing Code Appeals, said the board’s November 2010 decision on the four buildings on Hunter Circle has already been upheld by the Anderson County Chancery Court and the Tennessee Court of Appeals.

It wasn’t immediately clear what might happen next, including whether apartment owner Joe Levitt, a Knoxville attorney, might appeal the decision, and whether the city might issue an order to vacate the buildings. [Read more…]

Board will consider ‘unfit’ designations for four Applewood buildings

A Tennessee appellate court has sent an order to demolish four Applewood Apartment buildings back to a municipal board, and that board is scheduled to consider “unfit for human occupation and use” designations—but not demolitions—during a Thursday afternoon meeting.

The Oak Ridge Board of Building and Housing Code Appeals had ordered the four buildings on Hunter Circle demolished on Nov. 11, 2010. The order was upheld by the Anderson County Chancery Court, but Applewood Apartments owner Joseph J. Levitt Jr., a Knoxville attorney, appealed. [Read more…]

Four ORPD sergeants ask court to order salary increase

Four veteran Oak Ridge Police Department sergeants, including one who has retired, have asked an Anderson County court to order that their pay be increased to $61,000 per year so they will earn as much as two less-experienced sergeants.

The four sergeants have requested that the pay increase be effective starting Jan. 8, 2012, when they filed a grievance.

They also want the court to overturn or modify a Sept. 7 order from the Oak Ridge Personnel Advisory Board that dismissed their grievance and found no violation of the city’s personnel ordinance.
