A small electrical fire at the Applewood Apartments on Hillside Road around noon Thursday displaced about two dozen residents, authorities said.

The fire was caused by an electrical short in the main power supply leading into the distribution system in the basement of a building at 184 Hillside Road, Oak Ridge Fire Department Chief Darryl Kerley said.

The fire at the basement fuse box was quickly extinguished with an extinguisher, ORFD Battalion Chief Marty Griffith said. He said a circuit breaker did its job, turning off power and minimizing damage. [Read more…]

The Oak Ridge municipal staff has posted yellow “Danger” signs on units at four Applewood Apartment buildings on Hunter Circle.

A few days after a city board declared them unfit, the Oak Ridge municipal staff posted yellow “Danger” signs on four Applewood Apartment buildings on Hunter Circle, officials said.

Posted on Tuesday, the placards say the 48 apartment units have been deemed unfit for human occupation or use, said Denny Boss, Oak Ridge code enforcement supervisor. The notices cannot be removed until the structures are repaired or demolished.

Joe Levitt, the Knoxville attorney who owns the apartments, disagrees that they are dangerous.

“The buildings are in satisfactory engineering and architectural condition,” he said Thursday. “There’s no question about that.” [Read more…]

With no objections from members, a city board on Thursday reaffirmed a decision from more than two years ago to declare four Applewood Apartment buildings unfit for human occupation and use, and declare them nuisances.

Joe Lee, a member of the Oak Ridge Board of Building and Housing Code Appeals, said the board’s November 2010 decision on the four buildings on Hunter Circle has already been upheld by the Anderson County Chancery Court and the Tennessee Court of Appeals.

It wasn’t immediately clear what might happen next, including whether apartment owner Joe Levitt, a Knoxville attorney, might appeal the decision, and whether the city might issue an order to vacate the buildings. [Read more…]

Board will consider ‘unfit’ designations for four Applewood buildings

A Tennessee appellate court has sent an order to demolish four Applewood Apartment buildings back to a municipal board, and that board is scheduled to consider “unfit for human occupation and use” designations—but not demolitions—during a Thursday afternoon meeting.

City doesn’t plan to appeal Applewood demolition decision

The city’s top legal official on Monday said he doesn’t plan to appeal an appellate court decision that sent the order to demolish four Applewood Apartment buildings back to a municipal board.

“I don’t want to hold this up by appealing this any further,” Oak Ridge City Attorney Ken Krushenski said. “We’re going to do what the Court of Appeals said.”

The Oak Ridge Board of Building and Housing Code Appeals ordered the buildings demolished on Nov. 11, 2010. The order was upheld by the Anderson County Chancery Court, but Applewood Apartments owner Joseph J. Levitt Jr., a Knoxville attorney, appealed.

In a three-judge opinion filed Oct. 30, the Tennessee Court of Appeals in Knoxville said the Board of Building and Housing Code Appeals “acted without material evidence to support its decision to demolish the buildings.”

The appellate court said the board may only order demolitions when repair costs exceed 50 percent of property values. However, no evidence was presented at the 2010 Applewood hearing about the original condition or value of the buildings, or the repair costs, the court said.

The city won on all other issues, Krushenski said.

“As far as we’re concerned, everything else is over with,” he said.

Krushenski said the Board of Building and Housing Code Appeals will now have an evidentiary hearing that will be limited to the building and repair costs. He said the board will be able to consider demolition orders if repair costs exceed more than 50 percent of building values. A hearing date hasn’t been set yet.

In its opinion, the Court of Appeals said board member Joe Lee “moved to order the demolition of the subject buildings because he believed that (Levitt) had already been given an adequate amount of time in which to repair the buildings.

“While (the) owner’s continued noncompliance may have been infuriating to the board, the board did not have the power to order the demolition of property simply because owner failed to follow directions,” the court said.

The other issues reviewed by the court ranged from the constitutionality of administrative warrants used to inspect Applewood buildings to Lee’s alleged bias against Levitt.

Levitt could appeal the court’s decision to the Tennessee Supreme Court. He wasn’t available for comment late Monday afternoon

There are total of 10 Applewood Apartment buildings that have been ordered demolished. Krushenski said the other six demolition cases are pending in Anderson County Chancery Court.

The Oak Ridge City Court has ordered that three more buildings be repaired. That order has been appealed to Anderson County Circuit Court, Krushenski said.

The city has fought a code enforcement battle against the 13-building apartment complex on Hillside Road and Hunter Circle for several years. City officials say they want the buildings repaired, while Levitt says he has made repairs.

Housing report recommends more new homes, rental units

The competition to provide housing for workers is fierce, and Oak Ridge needs more new homes in the $180,000-$280,000 price range and more rental units in the $900-$1,200 price range, according to a housing report presented to Oak Ridge City Council by the Oak Ridge Chamber of Commerce on Tuesday.

Also proposed in the housing report: the development of attractive, convenient mixed use gathering spaces; improving the appearance of existing neighborhoods through aggressive codes enforcement; beautification projects in public spaces to make Oak Ridge more appealing; developing and implementing a consistent “brand” for Oak Ridge that encompasses livability, economic development, and tourism; incentivizing home improvements in the Manhattan District Overlay; and developing public/private partnerships to work on housing.

The report, which was presented to City Council in a non-voting work session on Tuesday, studied where Oak Ridge employees live, based upon the zip codes of 7,372 employees from eight major Oak Ridge employers. It found that 22 percent of Oak Ridge workers live in Oak Ridge. That’s compared to 44 percent who live in Knox County, primarily in Farragut, Hardin Valley, Northshore, Karns, and Cedar Bluff.

Ten percent of the Oak Ridge workers live in Roane County, 6 percent live in Clinton, and less than five percent each live in Loudon, Blount, Morgan, and other counties, the report said.

The housing report only reviewed Oak Ridge as it compares to the five most popular communities where people who work in Oak Ridge choose to live (Farragut, Hardin Valley, Northshore, Karns, and Cedar Bluff).

“Competition for residents is fierce, and Oak Ridge competes with some of the most desirable communities in the region,” the report said. [Read more…]

Lee keeps seat on housing board despite Council member’s removal request

Those who wanted to remove Joe Lee from a municipal housing board said he had shown contempt for Oak Ridge City Council members, insulted traffic camera critics, embarrassed the city, and bullied others.

But those who wanted to keep him on the board said Lee ought to be given a second chance. They said he had performed well on the board—the Oak Ridge Board of Building and Housing Code Appeals—particularly when considering the city’s code violation cases against the Applewood Apartments.

On Monday, the Oak Ridge City Council rejected the request to remove Lee from the board. The proposal failed in a 2-4 vote.

Voting in favor of the removal were Council members Anne Garcia Garland and Trina Baughn. Voting against it were Mayor Pro Tem Jane Miller and Council members Charlie Hensley, Chuck Hope, and David Mosby. [Read more…]

An Oak Ridge official wants the City Council to consider removing Joseph Lee from a city housing board because of his criticism—she called it contempt—for the council members who voted against renewing the controversial traffic camera contract in March.

The City Council will consider removing Lee, who serves on the Oak Ridge Board of Building and Housing Code Appeals, during a Monday, April 14, meeting.

“I was not at all surprised by the 4-3 vote,” Lee wrote in a March 28 e-mail to Council member Anne Garcia Garland, who made the request to consider removing him on Monday. “After all, it was not about safety or the money, it is about the votes. Take the fact that your entire campaign to be elected to city council and combine that with the nut jobs that you are aligned with and cater to, it has been obvious for a very long time that we were never going to hear the end of your whining until you got another shot at this issue. ORFD chief says Utica Circle fire was set

Power has been restored to an Applewood Apartments building on Hillside Road after a Thanksgiving Day electrical short displaced two dozen residents, and most of another two dozen residents can move back into McKenzie Acres apartments on Utica Circle, two days after they were displaced by a Saturday night fire, city officials said Monday.

The two fire calls in three days displaced about 50 people during the Thanksgiving weekend. The Red Cross has helped the residents with food and shelter, and residents and restaurants have pitched in as well.

The city hoped to get the residents back into their buildings today, Oak Ridge Fire Department Chief Darryl Kerley said Monday afternoon. [Read more…]

The second apartment fire in Oak Ridge since Thursday has displaced another two dozen residents.

The Saturday night fire started at about 9:22 p.m. in the 300 block of Utica Circle at McKenzie Acres. Firefighters were able to quickly extinguish the second-story blaze, and no one was injured.

But roughly 25 residents, including children, will not be able to return home to the eight-unit building tonight, authorities said. The Red Cross was on its way to Utica Circle to help the residents, who huddled outside in pajamas, coats, gloves, and hats as temperatures dropped to freezing at about 11 p.m. Saturday. [Read more…]
