Anderson County District Attorney Dave Clark and Public Defender Tom Marshall will be the guest speakers at Lunch with the League on Tuesday, February 17. The program will be held at noon in the Social Hall of the Oak Ridge Unitarian Universalist Church at 809 Oak Ridge Turnpike.

There won’t be defendants, witnesses, or a jury but the prosecutor—Dave Clark—and the defender—Tom Marshall—will discuss the current status of the Anderson County criminal justice system.

The Seventh Judicial District encompasses all of Anderson County. The district attorney is responsible for the prosecution of all criminal cases on behalf of the citizens of the state. The public defender’s office represents individuals accused of crimes who cannot afford a lawyer. Both the district attorney and public defender are elected for eight-year terms. [Read more…]

DA: No suspect, no charge in alleged rape by officer or security guard

The six-month investigation of an alleged rape by a security guard or police officer has been completed, and no suspect has been identified and there is no basis for a criminal charge, Anderson County’s top prosecutor said. Also, the credibility of the alleged victim is in doubt, District Attorney General Dave Clark said in a Tuesday letter to Oak Ridge Police Chief Jim Akagi.

The Oak Ridge Police Department reported the alleged rape in June. An adult female had reported that she was raped by a uniformed man who appeared to be a police officer or security guard, although it wasn’t clear if a specific agency was ever named. The woman reported that she was handcuffed and raped behind Oak Ridge Mall in the back seat of a police-type cruiser.

The woman was interviewed by Oak Ridge police officers, and the ORPD then contacted the Anderson County District Attorney General’s Office, which notified the Tennessee Bureau of Investigation of the allegation.

“Due to the nature of the allegation, Chief Akagi thought it would be best to have another agency conduct the investigation,” Clark said in a two-page investigative report.

A criminal investigation is under way in the death of a 29-year-old man at an apartment in Oak Ridge early Monday, but there has not been an arrest yet and no charges have been filed, Anderson County District Attorney General Dave Clark said Thursday.

Thomas Steven Thrasher Jr., 29, was found dead in a second-floor apartment when the Oak Ridge Police Department responded to a report of a possible intruder at about 4:40 a.m. Monday at 615 West Vanderbilt Drive.

Clark said an autopsy has been performed by the Anderson County medical examiner.

“As a result of the circumstances, the Oak Ridge Police and the Tennessee Bureau of Investigation have been conducting a criminal investigation,” Clark said. “There has been no arrest or charges filed at this time.” [Read more…]

With Best’s agreement, the passwords to the department’s computers had been changed, and a few Anderson County Sheriff’s Department deputies were stationed near the entrance to the HR office as Best and Anderson County Mayor Terry Frank sought to resolve a dispute over how to copy two computer hard drives in the office.

 

CLINTON—After the sheriff intervened, the Anderson County mayor and human resources director remained at a standoff Wednesday afternoon over how to copy the hard drives of two computers in the county’s Human Resources Department.

The hard drives could contain personnel records related to building inspector Lisa Crumpley, who was terminated on October 9 and has threatened to sue the county. Her personnel file has been reported missing.

Anderson County Mayor Terry Frank said she wants to preserve records related to Crumpley’s wrongful termination claim, as instructed by Knoxville law firm Kramer Rayson LLP, which represents Crumpley.

On Tuesday, the day after Human Resources Director Cathy Best announced her resignation, Frank proposed sending the hard drives used by Best and Human Resources Generalist Kerri Ashley, who has also resigned, to a Knoxville company to have copies made.

But Best objected, Frank said, and the mayor had a technician from Computer Systems Plus come to the Anderson County Courthouse in Clinton on Wednesday morning to make copies on-site. The county consultant had started disassembling the computers when Sheriff Paul White showed up, and the technician quit working because he believed he could be arrested if he continued, the mayor said.

Best said she does not object to copying the hard drives, but she wants to ensure that the proper procedure is followed. She said her department’s hard drives could contain health information that is not public, conversations with attorneys during the past 10 years, and information that might relate to an investigation by the Anderson County Sheriff’s Department of Crumpley’s missing personnel file.

Anderson County Mayor Terry Frank has questions for District Attorney General Dave Clark concerning the indictment of Public Works Director and Building Commissioner David Crowley.

A letter hand-delivered from the mayor’s office to the DA’s office states that the five misdemeanor charges handed down against Crowley last week by a grand jury do not meet the legal standards for those charges.

Crowley, who was appointed by Mayor Frank in September of 2012, was charged last week with five counts of inspecting houses without the proper certification following a TBI investigation. He turned himself in at the Anderson County jail Thursday morning, posted a $1,000 bond, and returned to work that same day. [Read more…]

Honors: DA Clark named a governor of Tennessee Bar Association

District Attorney General Dave Clark has been named a governor of the Tennessee Bar Association. The 23-member board controls the activities and business of the Tennessee Bar Association in all its activities across the state.

The TBA represents more than 10,000 lawyers in Tennessee in trying to “foster legal education, maintain the honor and dignity of the profession of law, cultivate professional ethics, and promote improvements in the law and administration of justice,” a press release said.

“It is an honor to be selected to serve in a leadership role among my peers and to help continue the service of the Tennessee Bar Association,” Clark said in the release.

Clark, who represents the Seventh Judicial District (Anderson County), was elected to a second eight-year term as DA in the August 7 county election.

State officials will seek the death penalty against a pair accused in the murder of a 79-year-old man whose body was found hidden underneath an apartment staircase on Patt Lane in Claxton two years ago, authorities said.

Norman Lee Follis Jr., 50, and Tammy Sue Chapman, 46, are accused of killing Sammie J. Adams sometime between December 5, 2011, and January 24, 2012, Anderson County District Attorney General Dave Clark said in a Monday announcement. Adams’ body was found under a stairwell in his home after friends and neighbors reported that they hadn’t seen him in a while, Clark said.

Adams’ age—he was over 70—was an aggravating factor leading to the death penalty request, Clark said. [Read more…]

Anderson County Mayor Terry Frank was elected to her first four-year term on Thursday, and Sheriff Paul White was elected to a third term.

The election featured several close races, including for sheriff and register of deeds, and there were a few upsets, including for Anderson County Circuit Court Clerk, County Commission District 3, and General Sessions Judge, Division II, where longtime Judge Ron Murch suffered defeat.

In the race for the Tennessee House, Representative John Ragan, an Oak Ridge Republican, beat back a primary challenge by newcomer Caitlin Nolan.

All 27 precincts have reported.

Here are the final unofficial election results for contested races:

Anderson County Mayor

  • Terry Frank, the Republican incumbent—7,586 (52.69 percent)
  • Jim Hackworth, a Democrat—6,193 (43.01 percent)
  • Bradley Rickett, an Independent—619 (4.3 percent)

Frank, who was first elected to a two-year term in a special election in August 2012, beat Hackworth, a former state representative and county commissioner, by about 1,400 votes. The two fought over a 1990 tax hike and “turmoil” and lawsuits in the Anderson County Courthouse.

  • Paul White, the Democratic incumbent—7,386 (51.64 percent)
  • Anthony Lay, a Republican—6,918 (48.36 percent)

White’s margin of victory was just under 500 votes. Lay is a former sheriff in Scott County, and he is currently a Tennessee Highway Patrol trooper. The two candidates battled over the food served at the Anderson County jail, crime rate statistics, and the responsiveness of the Sheriff’s Department, among other things. [Read more…]

DA responds to political targeting charge

There was no political targeting of Trooper Anthony Lay before his five-day suspension by the Tennessee Highway Patrol in May, but there were “real, serious, and repeated performance failures,” Anderson County District Attorney General Dave Clark said Friday.

Clark documented what he called Lay’s performance issues in a statement released Friday. A DUI charge in one case was dismissed, Clark said, after Lay failed to submit a complete case file and then did not respond to requests for documents by fax, mail, and email. He cited two cases where Lay failed to appear in response to a subpoena. In one of those cases, Lay faced potential arrest for contempt of court and showed up 20 minutes late, but the judge dismissed the case because Lay wasn’t present, the DA said.

Clark said he saved Lay from going to jail in that case because he declined to have the trooper arrested and instead called his sergeant to see if he could get Lay to court to avoid further trouble.

Clark cited another case where he said Lay failed to arrest a driver who was impaired and had four or more prior DUI convictions, possessed drugs and drug paraphernalia, and was a habitual motor vehicle offender. Lay issued the driver a ticket, but he should have taken the driver into custody after the man finished his medical treatment, Clark said.

In issuing his statement Friday, Clark said he was responding to Lay’s charges in recent stories about the trooper’s suspension by the THP in May. In those stories, published in several media outlets, Lay said he was the target of political attacks. [Read more…]

A candidate for Anderson County sheriff suspended by the Tennessee Highway Patrol in May said he has been the target of political attacks.

THP Trooper Anthony Lay was suspended for five days in May for unsatisfactory job performance, a spokesperson said Monday. The suspension was based on several factors, including insubordination, neglect of duty, failure to perform the duties of his job, non-compliance with an internal database system, and having an unsecured patrol unit in a populated area, said Dalya Qualls, public information officer for the Tennessee Department of Safety.

The administrative review that led to Lay’s suspension was received in April 2014.

Lay said he had been off work for five months because of back surgery, and Anderson County District Attorney General Dave Clark reported that Lay had not turned in some requested case file documents. Lay said he did not receive the letter requesting the documents, and the request letters were apparently sent to a Knoxville office.

Judge Ron Murch recently met with Anderson County Veterans Affairs Officer Leon Jaquet and Tennessee Assistant Commissioner of Veterans Affairs Don Smith to discuss the implementation of a Veterans Court/Docket in the Anderson County General Sessions Court. Smith has been visiting judges in East Tennessee to discuss the commencement of veterans courts, a press release said.

The Veterans Court/Docket would operate within the framework of the existing Sessions Court and would identify veterans within the court system, the release said. It would coordinate services available to them through the VA that would assist with drug and alcohol problems, stress problems, and other needs such as housing, education, job training, medical services, or any other services or VA benefits available to them. The Veterans Court/Docket would involve mentors, who are also veterans, that would assist veteran defendants in getting to court and to any scheduled appointments for services, and working with the County Veterans Office to coordinate available benefits. Clinton will receive a Tennessee Municipal League award for police service during a conference in Chattanooga on Tuesday, a press release said.

The 2014 Tennessee Municipal League Achievement Award for Excellence in Police Service will be presented at 8 a.m. Tuesday during TML’s 75th Annual Conference at the Chattanooga Convention Center in Chattanooga.

The award is being presented in recognition of the city’s efforts to provide a model police department to the community, the release said.

“A culture of planning, caring and excellence; it’s what takes a municipal Police Department from ordinary to outstanding,” the release said. “And the Clinton Police Department is all that. A model of efficiency and outreach, officers—several with advanced specialty degrees—strive to provide the utmost in community service and training to area schools and other agencies, while being good stewards of the community resources.
