Man, woman receive sentences of 3-5 years in robbery pleas

A Powell woman received a five-year sentence and a Knoxville man received a three-year sentence when they pleaded guiltyÂ to a robbery in Claxton that authorities said started with an advertisement for escort services posted on backpage.com.

Lindsay Elaine Pressley, 29, entered her plea agreementÂ in Anderson County Criminal and Circuit Court in Clinton on October 29.

Her co-defendant, Richard Paul Pressley, 32, entered his plea agreement last week, on Tuesday, April 2.

As part of their plea deals, an aggravated robbery charge filed against both Pressleys was reduced to robbery. Their charges ofÂ especially aggravated kidnapping with a deadly weapon were reduced to kidnapping. And charges of conspiracy to commit especially aggravated kidnapping were reduced to conspiracy to commit aggravated kidnapping. Charges ofÂ conspiracy to commit aggravated robbery remained unchanged. All four charges are felony charges.

In each case, the sentences for the individual charges runÂ concurrently, or at the same time.

Trial set for man charged with vehicular homicide in death of 3-year-old

CLINTONâ€”Prosecutors and the defense have not been able to reach an agreement on a plea deal, so a two-day trial has been set for Jason Robert Braden II, the 25-year-old Anderson County man charged with two counts of vehicular homicide, among other charges, in the death of a three-year-old boy, Jason Robert Braden III, in a crash in Oak Ridge in January 2017.

Braden had two plea agreement hearings scheduled in Anderson County Circuit Court in Clinton last month, one on Friday, March 1, and the other on Friday, March 29. But no agreement was announced during either hearing. The date was rescheduled during the March 1 hearing, and on Friday, defense attorney David Stuart said the defense and the state wouldn’t be able to reach an agreement.

At the start of Friday’s hearing, Stuart said an issue had come up. Braden had requested copies of the discovery, potential evidence that could be used at trial, so copies were made and delivered to the jail, Stuart said. But they went to the wrong Jason Braden, and Jason Robert Braden thinks that’s an ethics breach, Stuart said.

Stuart said he would have to self-report the breach if he thought he had done something wrong. Other legal officials, such as the judge and district attorney general, would also have to report him if they thought he had done something wrong, Stuart said. [Read more…]

CLINTONâ€”A Clinton man was sentenced to 35 years in prison when he pleaded guilty on Wednesday to attempted second-degree murder, aggravated kidnapping, and aggravated assault in a series of assaults that involved four female victims in three cases.

One of the victims, a grandmother in her 70s, was hit in the face with a crowbar and had a fractured skull and teeth knocked out, according to facts cited in Anderson County Criminal Court during the plea agreement hearing in Clinton on Wednesday.

The defendant, Jason Bradley Braden, 30, was ordered to serve 100 percent of his 35-year sentence.

Man sentenced to 30 years in Oak Ridge shooting

CLINTONâ€”An Oak Ridge man was sentenced to the maximum 30 years in prison in an attempted murder case as part of a plea agreement on Thursday after a shooting last year left a woman with life-threatening injuries.

William Antwon Mollette, 44, pleaded guilty to attempted first-degree murder and possession of a firearm during a dangerous felony in Anderson County Criminal Court in Clinton on Thursday.

Mollette, who has a prior felony conviction in Alabama, received the maximum 25 years on the attempted first-degree murder charge, a Class A felony, and he received the maximum five years on the firearm possession charge, a Class D felony. The two sentences are to be served consecutively for a total 30-year sentence.

The victim of the shooting, Cathy Griffin, was agreeable to the 30-year sentence, Tony Craighead, deputy district attorney general in Anderson County, told Criminal Court Judge Don Elledge.

Griffin read a statement in court during the plea agreement hearing. She described being shot and stalked by Mollette at a home on Walsh Lane last year, having her lungs collapse and blood stream from her abdomen, and knowing that she, a nurse, was dying. [Read more…]

Woman sentenced to eight years after drugs discarded during police chase

A Knoxville woman who fled from the Tennessee Highway Patrol in a car in Anderson County last year as methamphetamine and heroin were discarded from the moving vehicle pleaded guilty to four charges and was sentenced to eight years in prison on Tuesday.

About 60Â grams of methamphetamine and less than a gram of heroin were thrown out of a car window and two patrol vehicles were hit during the police chase, which started in Clinton and ended in Rocky Top on Sunday, July 30, 2017, according to court proceedings and affidavits.

The plea agreement hearing for the driver of the 1992 Honda Accord, Clarissa Sharee Tindell, 25, was Tuesday in Anderson County Criminal Court in Clinton. Her plea was by information, meaning she entered a plea before she was formally charged in an indictment by the Anderson County Grand Jury. Early pleas can lead to agreements more favorable to defendants.

Tindell, who was represented by defense attorney Paul Sexton of Oak Ridge,Â had been charged earlier inÂ Anderson County General Sessions Court in Clinton in a case that included additional counts such as aggravated assault, possession of a firearm during a felony, speeding (117 mph in a 45 mph zone), and failure to yield the right of way, among other charges. Knoxville man pleads guilty to reckless homicide after boy drowns

CLINTONâ€”A Knoxville man pleaded guilty to reckless homicide on Friday in the death of a five-year-old boy in Anderson County about three years ago. The child was reported to have drowned after being reported missing.

James R. Baysinger, 63, pleaded guilty to the single count of reckless homicide in Anderson County Criminal Court in Clinton on Friday afternoon. As part of the plea deal, the stateÂ will not prosecute a second charge, aggravated child abuse or neglect when the victim, Odin Elwood Fitton, was less than eight years old.

Baysinger has a sentencing hearing scheduled for November 27.

There was no allegation in court on Friday that Baysinger intended to injure or kill Odin.Â Instead, the boy’s death was alleged to have resulted from recklessness.

DA: Thousands of pills seized during investigation of international drug sales

Thousands of pills were seized from a home in Anderson County during an investigation of prescription pills being shipped into the United States for distribution, possibly from Internet sales from international sources, authorities said Monday.

Three people have been indicted and arrested in the case. One was detained overseas this month, in the international airport in Dubai, United Arab Emirates, said Dave Clark, Seventh Judicial District attorney general.

The apprehension ofÂ Moshin Agha, 30, of India, was reported first by Oak Ridge Today on Monday. In a press release Monday afternoon, Clark said Agha, who had been entered into a national police database, was located at the international airport in Dubai sometime in the late evening of Friday, July 13, or early the next morning.

Agha’s co-defendants,Â Shelley Dawn Hicks Robbins, 44, and Gene McKinley Miller, 43, both of Anderson County, have already pleaded guilty in the case. [Read more…]

CLINTONâ€”A trial has been scheduled this month for an Oak Ridge woman charged with homicide afterÂ aÂ fatal car-motorcycle crash on North Illinois Avenue in January 2016.

The felony jury trial for Noelle Leigh Patty, 41, is scheduled for July 24 in Anderson County Criminal Court in Clinton. Patty has been charged with homicide in the death of motorcyclistÂ Rufus E. Shephard III, 44, of Oak Ridge.

On Friday, Anderson County Criminal Court Judge Don Elledge rejected a motion to dismiss two of the five charges filed against Patty: criminally negligent homicide and reckless endangerment when a deadly weapon is involved. The Anderson County Grand Jury has found probable cause on the five charges, Elledge said, and no facts or evidence had been presented to the court yet. He called the motion to dismiss “totally premature.”

Patty was indicted on the five charges by the Anderson County Grand Jury on August 1, 2017. Besides homicide and reckless endangerment, the charges included failure to yield the right-of-way resulting in death, failure to obey a traffic control device, and failure to provide proof of insurance.

TheÂ crash occurredÂ between a Cadillac STS car and Kawasaki Ninja motorcycle on Sunday evening, January 31, 2016, at the western exit of the Westcott Center, the Kroger shopping center. Authorities said Patty, who was driving the Cadillac, made an improper left turn from a right-turn-only lane at that exit, and she failed to yield to Shephard, who was riding the motorcycle north on North Illinois Avenue. Shephard died after he collided with the car, which was turning south in â€œthe pathway of northbound traffic,â€Â Oak Ridge Police Department Officer Chris Luethge said in arrest warrants filed after the crash.

In depth: Cromwell gets new trial in fatal July 4 fireworks crash

Lee Harold Cromwell, who was convictedÂ of homicide and aggravated assault after a fatal crash after fireworks three years ago, is eligible for a new trial on the aggravated assault charges, a state appeals court said Tuesday.

After reviewing several issues raised on appeal, theÂ Tennessee Court of Criminal Appeals in Knoxville upheld Cromwell’s one conviction of reckless vehicular homicide and his five-year sentence on that charge.

But citing misleading and confusing jury instructions,Â the court ordered a new trial in Anderson County Criminal Court in Clinton on the eight convictions of reckless aggravated assault. Those convictions, which were reversed by the appeals court on Tuesday, had helped to add seven years to Cromwell’s sentence.

“After our review, we affirm the evidence was sufficient to support the defendant’s convictions and the trial court properly sentenced the defendant, but (we) conclude the trial court committed reversible error in instructing the jury as to reckless aggravated assault,” the Tennessee Court of Criminal Appeals said. “Therefore, we vacate the defendant’s eight convictions for reckless aggravated assault and remand this case to the trial court for a new trial.”

Exclusive: Cromwell, co-defendants sentenced to 20-50 years for fraudulent liens

NASHVILLEâ€”Five East Tennessee men who have been identified as “sovereign citizens,” including one from Oak Ridge and another from Clinton, were sentenced to 20-50 years in prison on Wednesday after filing fraudulent liens worth hundreds of millions of dollars against public officials, law enforcement officers, and others.

The five defendantsâ€”who included Austin Gary Cooper, 69, of Clinton, and Lee Harold Cromwell, 68, of Oak Ridgeâ€”had earlier been convicted of more than 200 counts of forgery and filing unlawful liens. That was at the end of a six-day trial inÂ Davidson County Criminal Court in Nashville in late April.

Their sentencing hearing was Wednesday. It lasted more than three hours.

Settlement reached after crash between motorcycle, city electric truck

A financial settlement has been reached after a crash between a motorcycle and an Oak Ridge Electric Department utility truck in August 2016 left an Anderson County man with critical, life-threatening injuries, broken bones and compound fractures, a head injury, permanent impairmentsâ€”and medical bills of almost $1 million, according to court records.

The settlement agreement between Don and Charlotte Wyrick, conservators for Brandon Wyrick, who was critically injured in the crash, and the City of Oak Ridge was approved byÂ Anderson County Circuit Court Judge Don Elledge in Clinton on January 23.

The agreement said Wyrick would be eligible to receive, under Tennessee law (Tennessee Code Annotated 29-20-403), no more thanÂ a damage cap of $300,000, if he were successful at trial. In December, the city agreed to pay that $300,000 maximum.

Also as part of the settlement agreement, the city’s insurance provider will “satisfy medical liens and subrogation interests” of about $663,000. That’s reported to be possible through the Tennessee Municipal League Risk Pool.

“This figure is above and beyond the tort cap and will be paid to the medical providers in previously agreed-upon amounts for expenses incurred to date,” the settlement agreement said. [Read more…]
