Death penalty decision expected in January

CLINTON—A decision could be announced in January about whether to seek the death penalty for two Oak Ridge defendants charged with three counts of first-degree murder each in the gruesome kidnapping, rape, and murder of a 36-year-old woman.

The victim, Jennifer Gail Paxton, was found during a search of a home on East Fairview Road on August 5, 2020, after the Oak Ridge Police Department responded to a report of a possible homicide. Paxton had allegedly been lured to the home with the promise of a place to stay but, once there, became the victim of a series of gruesome crimes, according to arrest warrants filed by Oak Ridge Police Department Sergeant Marvell Moore. She was allegedly kidnapped, tortured, raped, strangled, and her body stuffed into a freezer, according to the warrants.

The man and woman charged in Paxton’s death are Sean Shannon Finnegan, 54, and Rebecca Elizabeth Dishman, 23. They have both been charged with three counts of first-degree murder and 10 other charges, including aggravated rape and aggravated kidnapping. A prosecutor told a judge last year that the two could face the death penalty for the “especially heinous” murder. Both defendants have pleaded not guilty.

Finnegan and Dishman are charged in a separate case with aggravated rape of a child. A conviction in that case would result in an automatic sentence of life in prison without parole, Anthony Craighead, deputy district attorney general in the Seventh Judicial District in Anderson County, told Judge Steven Sword.

Evaluation ordered for Finnegan at Middle Tennessee Mental Health Institute

A forensic evaluation has been ordered for Sean Finnegan—one of two defendants in a murder, sex crimes, and kidnapping case in Oak Ridge—at Middle Tennessee Mental Health Institute.

The forensic evaluation was ordered last Tuesday by Anderson County General Sessions Court Judge Roger Miller. The order was based upon a petition by the defense and a recommendation from Ridgeview Behavioral Health Services. Finnegan, 52, had an evaluation scheduled at Ridgeview in Oak Ridge on August 31.

Under the new order, he is to be evaluated at the Middle Tennessee Mental Health Institute—Intensive Services Program for a maximum of 30 days regarding his competency to stand trial and his mental condition at the time of the alleged crimes (the insanity defense).

IQ testing is to be included in the evaluation, the order said. The mental health evaluation is also expected to include a finding about whether Finnegan meets specific criteria for being committed.

It’s not unusual for defendants in homicide cases to have a mental health evaluation of this type. The results are generally not available to the public.

Psychiatric, mental health exams scheduled for Finnegan, Dishman

Psychiatric and mental health evaluations have now been scheduled for the two defendants charged with murder, sex crimes, kidnapping, and abuse of a corpse in a series of gruesome crimes allegedly committed against a 36-year-old woman in a home in east Oak Ridge between December 2019 and August 2020.

The mental health evaluation for Sean Finnegan, 52, the first co-defendant, is scheduled for Monday at Ridgeview Psychiatric Hospital in Oak Ridge. His evaluation was ordered by Anderson County General Sessions Court Judge Roger Miller on Friday, August 21.

Finnegan’s evaluation by Ridgeview is expected to include his competency to stand trial and his mental capacity at the time he allegedly committed the crimes against Jennifer Gail Paxton, the 36-year-old Knoxville woman who was killed, according to arrest warrants. Finnegan’s evaluation is also expected to include an IQ test and an evaluation of his ability to assess his conduct.

The results of the evaluation will be reported to public defender Kathy Kroeger, the court, and prosecutors. The results are usually not available to the public.

Bond for Finnegan set at $1 million in murder, rape, kidnapping case

Bond for Sean Finnegan was set at $1 million on Monday. It’s the same bond his co-defendant, Rebecca Elizabeth Dishman, received on Friday.

Finnegan, 52, and Dishman, 22, are charged with murder, sex crimes, kidnapping, and abuse of a corpse after a 36-year-old woman, Jennifer Gail Paxton, was allegedly tortured, raped, and strangled, and her body was allegedly cut and broken before being stuffed into a freezer in a home in east Oak Ridge.

Finnegan has been charged with five felonies after the Oak Ridge Police Department responded to a homicide report at the home on East Fairview Road on Wednesday night and found Paxton’s body during a search of the home early Thursday. The five felony charges against Finnegan are first-degree murder, aggravated rape, aggravated kidnapping, abuse of a corpse, and tampering with evidence.

Dishman has also been charged with five felonies: first-degree murder, aggravated sexual battery, aggravated kidnapping, abuse of a corpse, and tampering with evidence.

Warrants: Woman tortured, raped before being killed

The 36-year-old woman found dead in an Oak Ridge home early Thursday had been lured there with the promise of a place to stay, according to arrest warrants.

But once at the home on East Fairview Road, she became the victim of a series of gruesome crimes, including murder, according to the warrants, which were filed by Oak Ridge Police Department Sergeant Marvell Moore.

The woman was held against her will, tortured, and raped before she was killed, the warrants said.

She was chained to a bed and shackled with a dog collar, said the warrants, which were filed in Anderson County General Sessions Court in Oak Ridge. She was struck on the head and an arm with a baseball bat so she wouldn’t resist or try to escape the attacks, and her arms were bound with zip ties, the warrants said.

Once she was incapacitated, the two defendants in the case, Sean Finnegan, 52, and Rebecca Dishman, 22, both of Oak Ridge, repeatedly raped her before strangling her, causing her to die, the warrants said.

A new two-hour “Dateline” on Friday will focus on the bank heists by Michael Benanti and Brian Witham, two men who pleaded guilty to or were convicted of their roles in a violent bank extortion and robbery spree in four states and several cities, including Oak Ridge and Knoxville, NBC News said this week.

Man, woman receive sentences of 3-5 years in robbery pleas

A Powell woman received a five-year sentence and a Knoxville man received a three-year sentence when they pleaded guilty to a robbery in Claxton that authorities said started with an advertisement for escort services posted on backpage.com.

Lindsay Elaine Pressley, 29, entered her plea agreement in Anderson County Criminal and Circuit Court in Clinton on October 29.

Her co-defendant, Richard Paul Pressley, 32, entered his plea agreement last week, on Tuesday, April 2.

As part of their plea deals, an aggravated robbery charge filed against both Pressleys was reduced to robbery. Their charges of especially aggravated kidnapping with a deadly weapon were reduced to kidnapping. And charges of conspiracy to commit especially aggravated kidnapping were reduced to conspiracy to commit aggravated kidnapping. Charges of conspiracy to commit aggravated robbery remained unchanged. All four charges are felony charges.

In each case, the sentences for the individual charges run concurrently, or at the same time.

A Claxton woman has been indicted in an alleged robbery at gunpoint in Claxton in 2016 that authorities said started with an advertisement for escort services posted on backpage.com.

Lindsay Elaine Pressley, 27, was indicted by the Anderson County Grand Jury on November 7. She was arrested Thursday and remained jailed in the Anderson County Detention Facility on Saturday night, with her bond set at $100,000.

The grand jury indicted Pressley on four charges: aggravated robbery, especially aggravated kidnapping with a deadly weapon, conspiracy to commit aggravated robbery, and conspiracy to commit especially aggravated kidnapping.

In July, the grand jury indicted a Knoxville man, Richard Norman Pressley, 31, in the case. He was also charged with aggravated robbery, especially aggravated kidnapping using a weapon, conspiracy to commit aggravated robbery, and conspiracy to commit especially aggravated kidnapping. The Pressleys had been identified as husband and wife in a press release from the Anderson County Sheriff’s Department after the alleged robbery and kidnapping in a mobile home on Queen Street in Ben’s Mobile Home Park off Edgemoor Road in Claxton on May 21, 2016. Kidnapping, assault charges sent to grand jury in Hibachi Burger robbery

Sixteen assault and kidnapping charges in a robbery reported at gunpoint at Hibachi Burger in Oak Ridge in January were sent to a grand jury on Tuesday.

An aggravated robbery charge was dismissed due to a technical issue with a warrant, but that charge is expected to also be considered by the Anderson County Grand Jury. An indictment by the grand jury would move the case from Anderson County General Sessions Court in Oak Ridge, where it has been, to Anderson County Criminal Court in Clinton.

The armed robbery was reported at about 6:10 p.m. Tuesday, January 10, at the Hibachi Burger restaurant, which is in Grove Center.

The defendant, Dominique Leshawn Gordon, 22, allegedly entered Hibachi Burger while displaying a firearm, and he demanded money from the register while showing the gun to several employees and customers, “placing them in fear of serious bodily injury,” according to affidavits filed in Anderson County General Sessions Court in Oak Ridge.

After getting the money, Gordon fled on foot, but he was caught a short time later by Oak Ridge Police Department patrol officers, the affidavits said. Officers who searched him after his arrest found the money that had been taken from the restaurant, according to the affidavits, which were filed by ORPD Detective A. Marvell Moore. [Read more…]

A Pennsylvania man was sentenced Tuesday to four consecutive life sentences in federal prison, plus an additional 155 years, for his convictions involving a violent bank extortion and robbery spree in four states and several cities, including Oak Ridge and Knoxville, authorities said.

Michael Anthony Benanti, 45, of Lake Harmony, Pennsylvania, was sentenced by Chief U.S. District Court Judge Thomas A. Varlan in Knoxville on Tuesday.

Benanti had been convicted by a jury after a trial in U.S. District Court in February 2017. The jury found him guilty of one count of conspiracy to commit robbery and armed bank extortion, two counts of attempted armed bank extortion, one count of armed bank extortion, three counts of carjacking, three counts of kidnapping, three counts of being a previously convicted felon in possession of a firearm, and 10 counts of using, carrying, and brandishing a firearm during and in relation to a crime of violence.

“Often, severe federal penalties, such as mandatory minimum sentences, are the most effective tool to protect the American public from a violent criminal like Benanti,” U.S. Attorney Nancy Harr said in a press release. “The consecutive sentences received by Benanti for firearms violations ensure he will never again be able to victimize families in East Tennessee or elsewhere. The U.S. Attorney’s office is, and remains committed to, prosecuting these crimes and seeking the highest penalties possible to help keep the American people safe.” [Read more…]
