Ninth District judicial race close; Supreme Court justices retained

U.S. Senator Lamar Alexander finished far ahead of a Tea Party challenger in the Republican primary on Thursday, and Representative Chuck Fleischmann narrowly beat Weston Wamp, the son of former Congressman Zach Wamp, in the second battle between the two men.

Alexander’s top opponent in the seven-candidate GOP primary was State Representative Joe Carr of Middle Tennessee. Alexander, who lost in his home district of Blount County, had 329,929 votes, compared to 269,883 for Carr, according to unofficial results posted by the Tennessee Secretary of State.

George Flinn, a Memphis radiologist and radio station owner, finished a distant third, with 34,568 votes.

Bill Haslam and Lamar Alexander

Governor Bill Haslam, left, and Senator Lamar Alexander touted the accomplishments of Republicans in Congress and Tennessee during a campaign stop at Dean’s Restaurant and Bakery in Oak Ridge on Wednesday, one day before Thursday’s state and federal primary elections.

Governor Bill Haslam and U.S. Senator Lamar Alexander campaigned in Oak Ridge on Wednesday as the two-term senator fought to prevail in the federal Republican primary in Tennessee on Thursday. The duo also promoted GOP accomplishments, both in Congress and in Tennessee.

Alexander is facing off against seven candidates for one of the state’s two U.S. Senate seats. Most of the attention has been focused on the race between Alexander and state Representative Joe Carr, a Republican Tea Party challenger from Lascassas in Rutherford County.

Alexander, who is also a former Tennessee governor, didn’t mention Carr by name during a stop at Dean’s Restaurant and Bakery in Oak Ridge on Wednesday.

Instead, he focused on accomplishments such as his vote to end “perpetual amnesty,” his “A” rating from the National Rifle Association, and the possibility that Republicans could gain a majority in the U.S. Senate. He also made some promises if Democrats lose control of the Senate.

“We’ll get rid of Harry Reid’s agenda,” said Alexander, referring to the current Senate majority leader, a Democrat. “We’ll get rid of ‘Obamacare.’” [Read more…]

U.S. Representative Chuck Fleischmann, the two-term incumbent, touts his seat on the powerful House Appropriations Committee and, important to Oak Ridge, the Energy and Water Subcommittee.

Meanwhile, Weston Wamp, his challenger, has suggested a willingness to work across party lines to “move the country forward.”

The two men face off in a in two-man battle in the Republican primary on Thursday. It’s in part a rematch of the three-man GOP primary in Tennessee’s Third District in 2012, when Wamp and Scotty Mayfield lost to Fleischmann. [Read more…]

Kingston Fossil Plant Ash Spill Cleanup

Ash that spilled into the brown embayment pictured above had been removed by June 2013, and workers placed a black plastic liner over an ash containment cell in the background, preparing to close it. The ash spilled in December 2008 when a storage cell failed at the Kingston Fossil Plant, back left.

KNOXVILLE—The Tennessee Valley Authority announced Friday that it will pay $27.8 million to settle dozens of lawsuits filed by hundreds of plaintiffs after the largest ash spill in U.S. history.

The 63 lawsuits that had been pending in U.S. District Court in Knoxville involved more than 850 plaintiffs. They had asserted claims against TVA arising from the 2008 ash spill at Kingston Fossil Plant. The lawsuits will be dismissed, bringing the legal battle to an end after more than five years.

The settlement, known as a mediated global resolution, was outlined in documents submitted Friday to the U.S. District Court in Knoxville, a press release said. It comes after nearly two years of mediation ordered by U.S. District Judge Thomas Varlan. The judge must still approve it.

The mediated global resolution has been approved by the TVA board of directors. TVA will pay the $27.8 million to the court clerk to be disbursed to the plaintiffs’ attorneys as ordered by the court, the release said. [Read more…]

While the majority of young students were using their break from school to enjoy nice weather and a variety of summer activities, 34 exceptional high school students along with 13 teachers from across 12 Appalachian states chose to spend two weeks of their summer vacation participating in a hands-on institute focused on math, science, and technology.

The Appalachian Regional Commission, Oak Ridge National Laboratory, and Oak Ridge Associated Universities hosted the 25th annual High School Summer and Math-Science-Technology Institute from July 7-18, during which the students and teachers worked on cutting-edge science projects with mentors at ORNL and participated in a variety of East Tennessee tours and activities.

Students were nominated by their state governor and chosen to participate in the program by ARC. They were selected based on their potential to excel in math and science, to continue in higher learning, and to influence others in their communities as the leaders of tomorrow.

Since 2000, the program has provided a total of 542 students and 223 teachers with in-lab learning experiences at one of the nation’s premier national laboratories. In addition, they have had the opportunity to visit some of the area’s most popular educational and recreational attractions. [Read more…]

EPA Green Power Community

Oak Ridge has been recognized as the first Green Power Community in the Southeast by the U.S. Environmental Protection Agency. Pictured above from left during a Monday night Oak Ridge City Council meeting are Oak Ridge Mayor Tom Beehan; Tennessee Representative John Ragan, vice chair of the House Energy Task Force; Robin Manning, executive vice president of external relations for the Tennessee Valley Authority; Marlene Witt, Oak Ridge business office manager; and Oak Ridge Electric Director Jack Suggs.

KNOXVILLE—The Tennessee Valley Authority has been recognized as a Top 10 utility leader in green power program sales, and Oak Ridge has been designated the first Green Power Community in the Southeast by the U.S. Environmental Protection Agency.

TVA was recognized by the U.S. Department of Energy’s National Renewable Energy Laboratory. In the first NREL Top 10 ranking in a decade, TVA landed at No. 9 nationally with green power sales of 199,067 megawatt-hours in calendar 2013, thanks to TVA’s Renewable Energy Solutions programs and participating local power companies, a press release said.

Oak Ridge is one of the participating communities, and it received the EPA designation based in part on TVA green power purchases. TVA and Oak Ridge officials had a brief ceremony to celebrate during a Monday night Oak Ridge City Council meeting.

“TVA is proud to be recognized nationally for our strong and growing support of renewable energy,” said Patty West, director of TVA’s Renewable Energy Solutions. “Cost-effective, renewable energy is an important part of TVA’s diverse portfolio of energy-generation sources.”

A key to TVA’s renewable energy sales has been Green Power Switch, or GPS, which TVA launched on Earth Day 2000 with local power companies and members of the environmental community as the first-of-its-kind renewable power purchase program in the Southeast, the press release said. [Read more…]

Three local state legislators are seeking photos of Vietnam War veterans from Anderson County who were killed in action in order to honor the fallen heroes at a new facility that complements the Vietnam Veterans Memorial Wall in Washington, D.C.

The photos are being sought by Tennessee Senator Randy McNally and Representative John Ragan, both Oak Ridge Republicans, and Dennis Powers, a Jacksboro Republican. The photos will be part of a multimedia display at the new facility, which will be built between the existing Wall and the Lincoln Memorial. The effort is part of the Vietnam Veterans Memorial Fund, or VVMF.

Senator Mark Green, a Clarksville Republican who is heading up the effort statewide, enlisted the help of the local lawmakers in trying to locate missing photos of local veterans for the memorial. [Read more…]

Pilot Flying J to pay $92 million for diesel fuel discount deception, cooperate with feds

Federal authorities announced Monday that Pilot Flying J will pay a $92 million penalty and fully cooperate with an ongoing investigation to resolve the company’s criminal liability for fraudulent conduct by employees in deceptively withholding diesel fuel price discounts from hundreds of customers.

Also known as Pilot Travel Centers LLC, Pilot has accepted legal responsibility for the criminal conduct of its employees, which caused more than $56 million in loss to its customers, and agreed to pay full restitution to every victim of the fraud, U.S. Attorney William C. Killian said in a Monday afternoon press release.

Pilot further acknowledged the gravity of its employees’ criminal wrongdoing by agreeing to pay the United States the $92 million monetary penalty—an amount within the fine range recommended by the U.S. Sentencing Guidelines, the press release said.

“The agreement also expressly states that it provides no protection from prosecution to any individual, and moreover, imposes a continuing obligation on Pilot to provide complete cooperation with the ongoing federal investigation of current and former Pilot employees relating to fraudulent conduct involving the sale of diesel fuel,” the release said.

Pilot must also periodically report to the United States what it has done to ensure that a system of internal accounting controls and other compliance procedures have been established to prevent fraudulent conduct from occurring again in the sale of diesel fuel. In the event Pilot materially breaches its obligations under the Criminal Enforcement Agreement, Pilot has agreed that the United States may file the criminal information, attached to the agreement, and will not contest the allegations in that charging document. KNOXVILLE—A Tennessee man who appeared on the television reality show “The Millionaire Matchmaker” has pleaded guilty in a $2.5 million extortion case involving the former managing contractor at the Y-12 National Security Complex in Oak Ridge.

Adam Winters, 26, of Robbins, Tenn., said he had copies of slides that would injure the reputation of the contractor, Babcock and Wilcox Y-12 LLC, and he met with undercover officers on May 23 to exchange the slides for the money he demanded, U.S. Attorney William C. Killian said in a Thursday afternoon press release. Law enforcement officers revealed their identity during that May 23 meeting and arrested Winters.

Earlier, on May 8, Winters had e-mailed Babcock and Wilcox and attempted to email Vice President Joe Biden about the slides, Killian said. After he sent the email, Winters used the Internet and telephone to communicate his threat to injure their reputation through the use of the slides, according to the plea agreement on file with the U.S. District Court in the Eastern District of Tennessee.
