Board orders demolition of Tyrone Road building, but Magic Wok excluded

A city board on Thursday ordered the demolition of this building on East Tyrone Road within 30 days. The Magic Wok restaurant, which is in a separate diner on the western side of the building, is not affected.

Despite a plea for another extension, a city board on Thursday ordered that a commercial building on East Tyrone Road be demolished within 30 days. The demolition order does not apply to the popular Magic Wok restaurant, which is in a separate diner on the western side of the building.

The Oak Ridge Board of Building and Housing Code Appeals had previously given the building owners more time to develop a repair or demolition plan, including a five-month extension in June. At Thursday’s meeting, board members suggested they hadn’t seen enough work take place since then.

“I’m seeing very little progress,” said board member Joe Lee, who made the motion to demolish within 30 days, which is what the city staff had requested. “This has been an ongoing issue for a decade or more.”

The city staff said the partially occupied commercial structure has been declared unfit for human occupation or use because of code violations, and a demolition deadline expired Thursday. The staff said the estimated cost of repairs exceeds 50 percent of the building’s value, which is an important benchmark for issuing a demolition order. The staff has said the building is in a state of disrepair, lacks adequate fire and panic exits, and the roof and interior have not been adequately maintained for several years.

The motion to demolish the building at 123 and 135 East Tyrone Road was approved in a 6-0 vote on Thursday. Voting in favor of that motion were Chair Bruce LeForce, Vice Chair Philip Nipper, Secretary Amy Seiber, Lee, and board members Phil Yager and Leonar Vaughen. Located in a small shopping center on Tyler and Tyrone roads, Classic Cleaners was given 10 days to vacate in February after the city staff said it found very serious code violations and structural issues in the building, which also houses a handful of other businesses.

A city board on Thursday will again hear the two cases against the owners of a commercial building judged to be “in disrepair” near the Magic Wok restaurant in central Oak Ridge.

In February, the Oak Ridge Board of Building and Housing Code Appeals tabled a demolition or repair order for 60 days to give the owners, Ma Shiu-Yen Wang and Ta-Shun Etal, time to sell the damaged property or develop a repair or demolition plan, the city staff said.

That 60-day postponement expired last Sunday.

The two cases concern the 50,000-square-feet commercial building at 123 and 135 E. Tyrone Road, just north of Oak Ridge Turnpike near Jackson Square. They exclude the manufactured structure that houses the Magic Wok, but they do include the areas in the small shopping center that have housed a dry cleaner, thrift store, wig shop, Mexican grocery, and the Magic Wok’s food preparation and overflow dining areas. Price Florist gets another 30 days for sale, repair, or demolition

A city board has declared Price Florist on Oak Ridge Turnpike a nuisance and unfit for human occupation and use, and members have given the property owner another 30 days to develop a repair plan, get a demolition permit, or reach an agreement to sell it.

The owner of the Price Florist property on Oak Ridge Turnpike has already been given two 30-day extensions to make repairs, demolish the building, or sell it.

On Thursday, the Oak Ridge Board of Building and Housing Code Appeals gave property owner Patricia Warren of Crossville one last extension.

“There’s no more 30 days,” board member Joe Lee said. “We’ve burned them up.” [Read more…]

A city board has declared Price Florist on Oak Ridge Turnpike a nuisance and unfit for human occupation and use, and members have given the property owner 30 days to develop a repair plan, get a demolition permit, or reach an agreement to sell it.

Price Florist on Oak Ridge Turnpike got another 30-day reprieve from a repair or demolition order.

Property owner Patricia Warren of Crossville said she is cleaning up the property and has three serious prospective buyers. Two, including a chain that sells “products that you consume,” would demolish the building, and the third would relocate an existing Oak Ridge business from the edge of town to the 0.35-acre site in the heart of the city, Warren said. A city board has declared Price Florist on Oak Ridge Turnpike a nuisance and unfit for human occupation and use, and on Thursday, members will reconsider a demolition or repair order for the building, which is now for sale.

A potential demolition order is looming, and the building is for sale.

For decades, it was home to Price Florist, but it’s now in “severe disrepair,” according to the Oak Ridge city staff.

In June, the Oak Ridge Board of Building and Housing Code Appeals declared the now-unused store on busy Oak Ridge Turnpike to be a nuisance and unfit for human occupation or use. The board stopped short of issuing a demolition order and gave the property owner 30 days to present a repair or demolition plan. [Read more…]

A city board on Thursday will consider ordering the demolition of a Lawton Road duplex that burned this summer.

The board will also consider ordering the repair or demolition of a warehouse on Tuskegee Drive that has a deteriorated exterior and exposed or open roof.

The Oak Ridge Board of Building and Housing Code Appeals will also consider whether to declare one abandoned unit in a duplex on Bettis Lane to be unfit for human occupation or use, and to order that it be repaired.

The board meets at 3 p.m. Thursday in the Municipal Building Training Room.

A meeting agenda said the Bettis Lane duplex unit has been neglected, is extremely unsanitary, and insects and rodents have been observed.

The owners of the Lawton Road duplex are interested in selling their property to the city, the agenda said.

The board is re-hearing the case of the Tuskegee Drive warehouse. Ceiling and roof sheeting and rafters are deteriorated and have been repeatedly exposed to moisture, and there are electrical system hazards and general fire safety violations, the agenda said.
