The U.S. Government Accountability Office will likely use one decision to rule on both protests of the consolidated contract to manage the Y-12 National Security Complex in Oak Ridge and the Pantex Plant near Amarillo, Texas, an official said Thursday.
The five-year contract was awarded to Consolidated Nuclear Security LLC, or CNS, on Jan. 8. But two bidding teams filed protests.
The first was filed on Jan. 17 by Nuclear Production Partners LLC, a team led by Babcock and Wilcox. The second was filed on Jan. 25 by Integrated Nuclear Production Solutions LLC, a team that includes Fluor and Jacobs.
By law, the GAO must rule on the first protest within 100 days.
On Thursday, Ralph White, head of the bid protest forum, said the GAO expects to rule on both by April 29, likely in a single decision. The decision is being written now, he said, but he could not comment on what the outcome might be.
White said the average bid protest decision is about eight to 10 pages, but this one will probably be longer than average because it’s a large bid with many issues.
The transition to CNS was put on hold after the first protest was filed. The contract with B&W Y-12, the current contractor at Y-12, expires April 29.
