A forensic evaluation has been ordered for Sean Finnegan—one of two defendants in a murder, sex crimes, and kidnapping case in Oak Ridge—at Middle Tennessee Mental Health Institute.

The forensic evaluation was ordered last Tuesday by Anderson County General Sessions Court Judge Roger Miller. The order was based upon a petition by the defense and a recommendation from Ridgeview Behavioral Health Services. Finnegan, 52, had an evaluation scheduled at Ridgeview in Oak Ridge on August 31.

Under the new order, he is to be evaluated at the Middle Tennessee Mental Health Institute—Intensive Services Program for a maximum of 30 days regarding his competency to stand trial and his mental condition at the time of the alleged crimes (the insanity defense).

IQ testing is to be included in the evaluation, the order said. The mental health evaluation is also expected to include a finding about whether Finnegan meets specific criteria for being committed.

It’s not unusual for defendants in homicide cases to have a mental health evaluation of this type. The results are generally not available to the public.

The 36-year-old woman found dead in an Oak Ridge home early Thursday had been lured there with the promise of a place to stay, according to arrest warrants.

But once at the home on East Fairview Road, she became the victim of a series of gruesome crimes, including murder, according to the warrants, which were filed by Oak Ridge Police Department Sergeant Marvell Moore.

The woman was held against her will, tortured, and raped before she was killed, the warrants said.

She was chained to a bed and shackled with a dog collar, said the warrants, which were filed in Anderson County General Sessions Court in Oak Ridge. She was struck on the head and an arm with a baseball bat so she wouldn’t resist or try to escape the attacks, and her arms were bound with zip ties, the warrants said.

Once she was incapacitated, the two defendants in the case, Sean Finnegan, 52, and Rebecca Dishman, 22, both of Oak Ridge, repeatedly raped her before strangling her, causing her to die, the warrants said.

The officer injured in a crash allegedly caused by a fugitive who was fleeing from police on Wednesday has been released from the University of Tennessee Medical Center in Knoxville, a spokesperson confirmed Friday.

Oak Ridge Police Department Officer Nathan Gibson was injured while trying to make a traffic stop and serve a warrant on Khristoff Deshawn Lee, 24, of Oak Ridge, on South Illinois Avenue at about 12:37 p.m. Wednesday, according to affidavits filed in Anderson County General Sessions Court in Oak Ridge.

Gibson has been discharged, UT Medical Center spokesperson Susan Wyatt said Friday afternoon. No information is available on his present condition.

It’s not clear what charges might have been in the warrant Gibson was trying to serve on Lee on Wednesday, but a writ of criminal capias had been issued for Lee after he failed to appear at a plea agreement hearing on attempted first-degree murder and robbery charges, among other pending charges, in Anderson County Criminal Court in Clinton on August 14. An Oak Ridge man allegedly broke into an apartment on Utica Circle on Monday, threatened a pregnant woman while brandishing a folding pocket knife, and demanded prescriptions and cash, Anderson County court records said. Sixty-three grams of methamphetamine were thrown out of a car window and two patrol vehicles were hit during a police chase that started in Clinton and ended in Rocky Top on Sunday, July 30, authorities said. The vehicle occupants also threw out about one-half gram of heroin, and the car they were in almost hit two Anderson County patrol vehicles head-on, the Tennessee Highway Patrol said.

That afternoon, THP Trooper Isaiah Lloyd tried to stop a black Honda sedan for failure to yield the right of way and a turn signal violation at the intersection of State Route 61 (North Charles G. Seivers Boulevard) and Longmire Road in Clinton, near the Clinch River and Anderson County Detention Facility, according to affidavits filed in Anderson County General Sessions Court in Clinton.

The 1992 Honda Accord had cut off a red pickup truck at the intersection, Lloyd said.

But the car refused to stop after he activated his emergency equipment, Lloyd said.

While the Honda was traveling down Longmire Road, the car occupants threw two items out the window, according to Lloyd:

  1. a baby formula can that contained a jar with about 63.93 grams of methamphetamine, and
  2. a black metal box that contained a set of scales, 0.53 grams of heroin, and multiple plastic bags.
