Y-12 Prepares Ferguson Protest Preparations

The Y-12 National Security Complex and City of Oak Ridge prepared for possible protests related to the announcement of the grand jury decision in Ferguson, Missouri, on Monday night. Y-12 had appeared on a list of possible Ferguson-related demonstration sites, but there didn’t appear to have been any protests at Y-12 as of Tuesday afternoon.

 

The Y-12 National Security Complex and Oak Ridge and regional law enforcement agencies had prepared for possible protests at Y-12 on Monday, when the grand jury decision was announced in Ferguson, Missouri, but there didn’t appear to have been any protests at the Oak Ridge plant as of Tuesday afternoon.

Y-12 had appeared among a list of demonstration sites on the Ferguson National Response Network Web page. The Y-12 protest was scheduled to start at 7 p.m. Monday, the day of the grand jury announcement, and demonstrators were asked to bring cell phones, cameras, signs, and megaphones.

But there didn’t appear to be anyone near the Scarboro road entrance to Y-12 at about 6:30 p.m. Monday or later at about 9:30 p.m. Scarboro Road was hemmed in on one side by Y-12’s temporary fence and on the other by City of Oak Ridge traffic barrels, cones, and police tape. Temporary barricades were erected to block Y-12’s entrances, and concrete barriers inside the main entrance appeared to have been angled in the roadway to deter or slow down unwanted visitors. The transition to a new contractor at the Y-12 National Security Complex in Oak Ridge and Pantex Plant near Amarillo, Texas, could start later this month—after the period for protests is over, federal officials said Friday afternoon.

The protest period ends around Nov. 25, the National Nuclear Security Administration said. The transition could start the day after the protest period ends and last four months, but the NNSA will ask the new contractor, Consolidated Nuclear Security LLC of Reston, Va., to complete the transition quicker if possible.

It’s not clear yet if the two teams that submitted unsuccessful bids will lodge new protests. There have already been two rounds of protests over the contract, which could be worth up to $22.8 billion during a 10-year period, and they have delayed the transition. KNOXVILLE—The temporary fence that blocks a traditional protest area at the Y-12 National Security Complex will stay up for now.

A group that has used the grass field and small parking lot for protests and vigils near the Y-12 entrance at Bear Creek and Scarboro roads had sought to have the fence removed before an annual spring demonstration on Saturday. Workers started erecting it on Monday.

But the arguments about the fence and its alleged violations of the protesters’ First Amendment rights took a surprise turn in U.S. District Court in Knoxville on Friday.

District Judge Curtis L. Collier quickly raised a question about whether the court has jurisdiction to address the complaint filed Wednesday by the Oak Ridge Environmental Peace Alliance, its board members, and people affiliated with the nonprofit organization. [Read more…]

U.S. attorneys argue that the federal government has the right to close a previously open public forum, including this area near the main entrance at the Y-12 National Security Complex that has been used for protests and vigils for years.

Protesters call it a violation of their First Amendment rights, but U.S. attorneys said a new fence at the Y-12 National Security Complex can remain in place because the federal government has the right to close a previously open public forum.

The new fence encloses a grass field and small parking lot near the main entrance to Y-12 at Bear Creek and Scarboro roads. It’s been used for protests, vigils, and gatherings for 25 years.

Workers started erecting a temporary version of the fence on Monday. Protesters have asked the U.S. District Court in Knoxville to order that it be removed before an annual spring demonstration on Saturday. [Read more…]

After several recent trespassing incidents, workers put up a new temporary fence at the Y-12 National Security Complex on Monday. An Oak Ridge peace group objects to the fence because it encloses an area traditionally used for protests.

Workers started erecting a temporary fence at the Y-12 National Security Complex on Monday, enclosing an area that has traditionally been used for protests by an Oak Ridge nonprofit group.

Federal officials said they are installing the fence along Scarboro Road after three trespassing incidents involving five people in the past year. In one of those incidents, three anti-nuclear weapons activists penetrated a high-security area and splashed human blood and spray-painted slogans on the Highly Enriched Uranium Materials Facility, where bomb-grade uranium is stored.

On Thursday, the National Nuclear Security Administration said recent events have shown a greater threat of trespassing, and the response costs are increasing. [Read more…]
