Meth, conspiracy charges dismissed after warrantless search

Citing a warrantless search, an Anderson County judge has dismissed drug and conspiracy charges in a case where police allegedly found 45.1 grams of methamphetamine in a backpack in an Oak Ridge motel room in May.

“I hate to dismiss serious charges,” said Roger Miller, judge of the Anderson County General Sessions Court, Division II, in Oak Ridge. But, he added, “I don’t think the proof would hold up.”

Suggesting that a search warrant should have been obtained, Miller said he is accessible and signs many search warrants.

The two people charged in the case had been William Michael Renfro, 18, of Oak Ridge, and Carlie Alise Wisman, 22, also of Oak Ridge.

Renfro had been charged with manufacturing, selling, delivering, or possessing a schedule II controlled substance (the 45.1 grams of meth), a Class A felony; criminal conspiracy, a Class B felony; manufacturing, selling, delivering, or possessing a schedule IV controlled substance (9.5 grams of marijuana), a Class D felony; and possession of a firearm (a Ruger Security Six .357 revolver with six rounds) during the commission of or attempt to commit a dangerous felony, a Class D felony.

All four of those charges were dismissed after a preliminary hearing for Renfro in Anderson County General Sessions Court on Thursday, December 12. During a preliminary hearing, a judge can hear from witnesses, victims, and police officers, and determine whether there is probable cause to send the charges to the Anderson County Grand Jury.

CLINTON—One charge of attempted first-degree murder and five counts of aggravated assault, among other charges, were sent to the grand jury after a two-hour preliminary hearing in July for an Anderson County man accused of pointing a revolver at two deputies and pulling the trigger two or three times.

The defendant, Charles Edward Mason, 52, had faced 24 charges, including two counts of attempted first-degree murder, eight counts of aggravated assault, three counts of aggravated kidnapping, and weapons and drug charges, among other violations. Eleven charges were sent to the grand jury, although it is possible that the grand jury could consider the charges that have been dismissed.

Mason, who unsuccessfully sought to represent himself during the hearing, has a violent crime history. He has previously pleaded guilty to two homicides, one in Knox County, Kentucky, in 1994 and the other in Anderson County, Tennessee, in 2010.

  A Rocky Top woman has been charged with three counts of first-degree murder in the death of an 83-year-old man during an alleged robbery in August. Christy Viola Comer, 38, faces one count of first-degree murder for the premeditated and intentional killing of J.C. Copeland, according to an indictment filed by the Anderson County Grand Jury in Clinton on March 5. Comer faces two more charges of first-degree murder for allegedly killing Copeland while committing two other crimes, aggravated robbery and aggravated burglary, according to the indictment. The five-count indictment also charged Comer with those two other crimes, aggravated robbery and aggravated burglary. Comer took Copeland’s property violently through the use of a deadly weapon, and she entered Copeland’s home without permission, intending to commit a felony, according to the indictment. Comer has an arraignment scheduled for the five felony charges on March 29 in Anderson County Criminal Court in Clinton. [Read more…]

Two attempted first-degree murder charges filed against a 20-year-old woman after a shooting in an Oak Ridge apartment parking lot in May have been sent to the Anderson County Grand Jury.

The charges against Kali Annabelle Bailey, whose last known address was in Powell, were bound over, or sent to, the grand jury, after a 100-minute preliminary hearing in Anderson County General Sessions Court in Oak Ridge on Tuesday, July 31. A victim and a police officer both testified during the preliminary hearing.

Bailey is accused of shooting into a Kia Optima car that had two people inside and was backed into a parking space in the Manhattan Apartments on North Purdue Avenue at about 11:03 p.m. May 6 as part of a possible dispute between two women over a man, which was described in court as jealousy or a “love triangle.”

Attempted murder charge sent to grand jury in Claxton shooting

CLINTON—An attempted first-degree murder charge has been sent to the grand jury in a case involving an Oak Ridge man accused of shooting and injuring two men and shooting near a woman but not hitting her.

Two charges of reckless endangerment were also bound over, or sent to the grand jury. Those charges had initially been filed as attempted first-degree murder.

A preliminary hearing for Jacob Lynn Rutherford, 23, was held Wednesday, March 7, in Anderson County General Sessions Court in Clinton.

Rutherford had originally been charged with a total of three counts of attempted first-degree murder and one count of reckless endangerment. One count of reckless endangerment was dismissed during the preliminary hearing last week, meaning Rutherford faces the one attempted first-degree murder charge and the two counts of reckless endangerment that were originally attempted murder. An attempted first-degree murder charge filed against an Oak Ridge man who allegedly admitted to shooting a woman over a grudge related to having to surrender a puppy has been sent to the grand jury, according to Anderson County court records.

William Antwon Molette, 44, had a preliminary hearing in Anderson County General Sessions Court in Oak Ridge on Tuesday, February 13.

Besides attempted first-degree murder, two other charges filed against Molette were bound over to the grand jury: armed dangerous felonies and violation of the sex offender registry.

One charge of armed dangerous felonies was dismissed. [Read more…]

An Oak Ridge woman has been indicted on charges of vehicular homicide and driving under the influence in the death of a 37-year-old Harriman mother and Roane County Schools employee in a three-vehicle crash in May.

The vehicular homicide charge alleges Vickie Gay Gilmore, 62, was driving recklessly in the crash that killed Christy Duncan, 37, of Harriman.

Gilmore has also been charged with reckless aggravated assault for injuring Duncan’s daughter Janna, who was four years old at the time of the May 6 crash at Oak Ridge Turnpike and Jefferson Avenue.

Gilmore has also been charged with reckless endangerment with a deadly weapon (a motor vehicle), reckless driving, and leaving the scene of an accident. She has an arraignment scheduled for 9 a.m. Friday, April 28, in Anderson County Criminal Court in Clinton.

The indictments were filed Tuesday by the Anderson County Grand Jury in Clinton. [Read more…]

An Oak Ridge woman is facing three more felony charges, including a second vehicular homicide charge, in the death of a 37-year-old Harriman mother and Roane County Schools employee after a three-vehicle crash at Oak Ridge Turnpike and Jefferson Avenue in May.

The new charges, filed against Vicki G. Gilmore, 62, on September 29, also include aggravated assault and reckless endangerment. The new homicide charge is vehicular homicide (recklessness).

The original charges filed against Gilmore, who is suspected of using a narcotic pain-reliever, were vehicular homicide, driving under the influence, reckless driving, failure to maintain a single lane, leaving the scene of an accident, violation of the implied consent law, and duty upon striking a fixture. The original charges were filed in May.

A preliminary hearing has been set for 10 a.m. October 21 in Anderson County General Sessions Court in Oak Ridge. During a preliminary hearing, a judge can hear from victims, witnesses, and investigators, and determine whether charges should be bound over, or sent to a grand jury for its consideration. Preliminary hearing set for January in fatal car-motorcycle crash

A preliminary hearing has been set for January 2017 for a woman charged after a fatal car-motorcycle crash on North Illinois Avenue in January 2016, court officials said.

The preliminary hearing has been scheduled for 9 a.m. January 19, 2017, in Anderson County General Sessions Court Division II in Oak Ridge.

The defendant, Noelle Leigh Patty, 29, of Oak Ridge, has been charged with failure to yield the right-of-way, resulting in death; a violation of the law to obey traffic control devices; and a failure to provide proof of financial responsibility.

There was a status hearing for Patty on Thursday, although she did not have to appear. She was expected to enter a plea, waive the charges to a grand jury, or set a date for a preliminary hearing. [Read more…]

Attempted first-degree murder charge reduced to felony reckless endangerment, sent to grand jury

The attempted first-degree murder charge filed against an Oak Ridge man after he allegedly shot his sister in the ear in April was reduced to felony reckless endangerment last week and waived to the Anderson County Grand Jury for its consideration.

The state will not pursue a second charge, an aggravated assault charge, against Eric Joe Wilson, 42. That charge was dismissed.

Wilson was to be released on intensified felony pre-trial release, and as part of that release, he is supposed to continue mental health treatment and his family is supposed to monitor his medications.

Anderson County General Sessions Court Judge Roger Miller agreed to remove a no-contact provision that was part of Wilson’s pre-trial release. Wilson’s sister, Suzan Stiles, the victim in the alleged shooting, said she takes care of Wilson, and he’s not done anything like this before. Miller confirmed with Stiles that she had not been threatened or intimidated into making the request. [Read more…]

CLINTON—Tennessee Highway Patrol troopers testified Thursday that a driver charged with vehicular homicide smelled of alcohol and said he had been drinking and had taken two anti-anxiety pills before a two-vehicle crash on Clinton Highway in April that resulted in the death of a 23-year-old Heiskell woman.

There was a half-empty bottle of whiskey found between the driver’s seat and the rocker panel of the 1993 Eagle four-door sedan, according to testimony by a crash witness and THP Trooper Isaiah Lloyd, the lead trooper in the investigation. Lloyd testified that he saw a glass marijuana pipe with residue in the center console of the car, a marijuana joint inside a prescription bottle, and at least six beer cans on the passenger floorboard of the car, although it wasn’t clear if the cans were empty or full.

The THP said Scott Gray, 26, of Knoxville, was driving north on Clinton Highway in the Eagle sedan near Mehaffey Road on Thursday evening, April 28, when he turned into the path of a southbound 2015 Jeep Grand Cherokee sport utility vehicle driven by Kimberly Williamson, 32, of Knoxville. The SUV driven by Williamson hit the car driven by Gray.

The passenger side of the Eagle had significant damage, and passenger Jessica Miner Taylor, 23, of Heiskell, was trapped and critically injured. After she was extricated, she was flown by a Lifestar medical helicopter to the University of Tennessee Medical Center in Knoxville, authorities said. She was immediately taken into the operating room because her bladder was torn from the crash, Lloyd said in arrest warrants filed in May.

Gray was taken by ambulance to UT Medical Center the day of the crash. Williamson had minor injuries, and she was taken in a personal vehicle to Tennova North, where she was treated and released, authorities said earlier.

Miner died from her injuries about a week after the crash, on Friday, May 6, according to her obituary. [Read more…]
