Third arrest in shooting that injured woman’s liver

Police have made a third arrest in the November 13 shooting that sent two people to the hospital, one with an injury to her liver, authorities said.

The Oak Ridge Police Department announced two arrests in the shooting last week: Tyler Earl Gulley and Sedrick D. Davis.

The third person, Daniel Michael Rose, 25, of Utica Circle, was arrested Wednesday, November 18. Rose has been charged with aggravated assault. He was released Tuesday, November 24, in lieu of a $50,000 bond, according to court records.

Rose was one of the two people injured in the Friday, November 13, shooting near the intersection of Fisk and Dillard avenues in the Scarboro neighbhood. He was struck in the left foot, police said.

Authorities said Rose was a passenger in a 2002 Chevrolet Impala driven by another victim, Josie Wisman, on Fisk Avenue at about 11:57 a.m. November 13. Rose asked her to stop the car near the intersection with Dillard Avenue, ORPD Detective William Weaver said in an arrest warrant.

“The defendant (Rose) exited the vehicle both displaying and firing a 9mm handgun at least two times, trying to inflict serious bodily injury on the co-defendant (Gulley) and placing the victim in harm’s way, causing her serious bodily injury,” Weaver wrote. “A co-defendant, Tyler Gulley, returned fire in the direction of the defendant and the victim’s vehicle and struck the defendant and victim with one bullet each. The victim was struck as she was driving away.”

Weaver said the bullet went through the rear passenger door and into Wisman’s abdomen as she turned right onto Dillard Avenue.

“The bullets caused the victim serious injuries,” Weaver said. “The victim was taken by Lifestar to UT Medical Center, where, as of this date—11/18/2015—where five days later, she is still receiving care for a bullet wound to her liver.”

Rose had a Taurus 9mm handgun when he was stopped by ORPD Officer John Thomas near Oak Ridge Fire Station Number 3 immediately after the shooting, Weaver said.

Last week, the ORPD said Gulley, 22, of Hampton Road, has been charged with two counts of aggravated assault in the alleged shooting.

Officers found one handgun at the scene, the Oak Ridge Police Department said in a press release Tuesday, November 17. They searched the area and executed a search warrant at 101 Hampton Road, where two firearms were recovered, a Glock 26 9mm and a Glock 22 40-caliber, authorities said.

Police said Davis was arrested Saturday, November 14, near an unrelated domestic disturbance near his home. Police said Davis was charged with two counts of aggravated assault from the Friday, November 13, shooting and reckless endangerment from the domestic disturbance on Saturday, November 14. Davis reportedly brandished a handgun during the Saturday morning incident, the ORPD said.

Gulley told police he was walking up Fisk Avenue that Friday, and Wisman and Rose pulled up in a 2002 Chevrolet Impala.

“Both Gulley and Rose exchanged words, and Gulley and Rose exchanged gunfire,” Weaver wrote in an earlier warrant. “Both Wisman and Rose were struck one time each by a handgun bullet.”

Rose and Wisman left the scene in a vehicle and traveled to a nearby fire station, Oak Ridge Central Fire Station on Tuskegee Drive, where they summoned a passing police officer, Thomas. Wisman was flown to the University of Tennessee Medical Center in Knoxville by a Lifestar medical helicopter, and Rose was taken to the hospital in an ambulance.

Last week, the ORPD said both investigations are ongoing, and more arrests could be pending.
